The zoning is — residence. The property under consideration is vacant and has a frontage of 50 feet on Laurel Avenue and 95 feet on Prior Avenue result- ing in an area of 4,750 square feet. The area uses are predomi- nantly single and two- family residential. Chapter 60.02 of the Legislative Zoning Code requires a minimum lot area of 5,000 square feet for a single - family residence in an "A" residence district. It is therefore necessary for the applicant to appeal to the City Council for permission to construct the proposed residence. Field investigation discloses no objection as the proposed use will be compatible with the existing area uses. The denial of this request would serve a definite hardship on the applicant as it would render the lot unbuildable. The area deficiency is 250 square feet, or approximately 5, The Board of Zoning considered this matter at their regular meeting on December 7, 1961 and recommend the granting of the appeal to construct a single - family residence on the above described property. November 3, 1961 Re: Lot 10, Block 161•Sec ®n1 Addition Merriam Park except the North 55 feet thereof. Gentlemen: Iam the purchaser of the above described premises, which is a• corner lot located at Prier and Laurel Avenues. This lot is 50 feet by 95 feet, and is being purchased for $3000.00. Prior to negotiating the purchase, I cleared with the office of the City of St. Paul issuing building permits and was informed I would have no obstacle in the issuance of a building permit for a single family residence. Relying on.this; I entered into an Earnest Money Contract to purchase said Let. On submitting of plans for issuance of building permit, I was informed the lot was 270 square feet below minimum size and a permit could not be issued. I am now informed that the ordinance allows a 10% allowance for the required area on a corner lot. I believe this lot meets this qualification. Therefore, I respectfully request the City Council to take such action as would enable me to procure a building permit for the building contemplated.
