Committee Date:
1 WHEREAS, the City of Saint Paul has sponsored a Sofrball on Ice Tournament for some 20 + years and is planning such an
2 event for February 3 and February 4, 2007 at Dean's Tavem and McCarron's Lake, located in the City of Roseville,
3 Ramsey County; and
� WHEREAS, Dean's Tavem is supportive of this event on the condition that the City of Saint Paul indemnifies and
6 holds harmless its agents aod officers; and
8 WHEREAS, the Saint Pau] City CQUncil finds that the Winter Camival Softball on Ice Toumament has ]e� tunate
9 public purpose by drawing participants to Saint Paul and offering family entertainment to the citizens of Saint Paul; and

11 WHEREAS, the expenditure of public funds, which includes the promise of indemnification and defense, for such a
12 purpose will facilieate and enable the event to take place; now, therefore, be it
13
14 RESOLVED, that the City Council of the City of Saint Paul on behalf of the Ciry of Saint Paul hereby agrees to defend,
15 indemnify and hold harmless Dean's Tavern from any and all damages it may be required to pay as a result of suits,
16 claims, actions, orjudgments arising out of the use of Dean Tavem as the host site for the 2007 Softball on Ice
17 Toumamern, which aze amibutable to Yhe negligent action or omission by the City of Saint Paul, its employees, agents or
18 conh and be it,

20 FURTHER RESOLVED, that Yhe foregoing defense and indemnification does not cover:

1. Any occurrences or events which are not part of the Softball on Ice event and which do not occur or
take place at Dean's Tavern and McCanon's Lake and during the course of the event.
2. Injuries or damages which arise from hidden traps or conditions existing on the grounds surrounding
Dean s Tavam and McCarron's Lake of which Ramsey County or the City of Roseville had actual
consYructive nofice.
3. Injuries which arise ouY of criminal actions, assaults, batteries or other acts of violence committed by
any person or persons.
;2 AND BE IT FURTHER RESOLVED, that nothing m the foregoing provisions shall be construed as a waiver of the
33 municipal tort liability limits seT forth in Minn Stat. 5466.01 et seq; and be it

35 FINALLY RESOLVED, that the proper City officials are hereby authorized to execute agreements which may be
36 necessary to implement this program on the City of Saint Paul's behalY.
