This property is legally described as follows, to wit: CHAMBER'S ADDITION LOT 7 BLK 2 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspecrions on or before October 25, 2006, the following are the now known interested or responsible parties for the Subject Property: Dale/Dist. 7 Planning Council, District7nc(c�vahoo.com; David R Johnson, 478 Cleveland Ave South, St Paul MN 55105-1327 WHEREAS, Department of Safety and Inspections has served in accardance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated May ll, 2007; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the shucture located on the Subject Property by June il, 2007; and WHEREAS, the enforcement officer has posted a placazd on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City C1erk schedule pub2ic hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served nofice in accordance with the provisions of Chapter 45 of the Saint Pau1 L,egisiative Code, of the rime, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Counci� on Tuesday, July 31, 2007 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendarion to approve the request to order the interested or responsible parties to make the Subject Property safe and not dehimental to the public peace, heaith, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the shucture in accordance with all applicable codes and ardinances. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, VacantlNuisance Buildings. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. �•� ' The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties sha11 make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcring a11 deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing ��151 89 90 91 92 93 94 95 96 97 98 99 100 101 102 103 104 105 rehabilitation or demolition and removal of the structure must be completed within r`�� one hundred-eighty (180) days after the date of the Council Hearing. 2. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. According to our files, it has been a vacant building since August 24, 2004. The cunent property owners are David R. Johnson and Arafat El Bala'i, per AMANDA and Ramsey county property records. There have been fourteen (14) SUMMARY ABATEMENT NOTICES since 2004. There have been seven (7) WORK ORDERS issued for: - Removal of improperly stored refuse - Removal of snow and ice - Removal of ta11 grass and weeds On May 8, 2007, an inspection of the bullding was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NLTISANCB BUILDING was posted on May 11, 2007 with a compliance date of June 11, 2007. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Ordering the owner to remove ar repair the building(s) at 294 Sherburne Avenue within fifteen (15) days from adoption of resolution. Arafat EI Balffi and David 7ohnson, property owners, appeared. Mr. El Balai stated that he had recently purchased the properiy from Mr. Johnson. Mr. Magner stated the building was a rivo-story, wood frame, single-family dwelling on a lot of 5,227 square feet and had been vacant since August 24, 2004. A code compliance inspection had been done on May 30, 2007. The vacant building registration fees had been paid. The $5,000 performance bond had not been posted. . On May 8, 20Q7, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on May 11, 2007 with a compliance date of June 11, 2007. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $51,500 and the building to be $60,800. Rea1 estate taxes for 2005-2006 were delinquent in the amount of $3,768.12. Code Enfarcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolirion was estimated to be approximately $8,000 to $10,000. There had also been 14 summary abatements issued to this property seven of which went to work order: remove improperly stored refuse, remove tali grass and weeds and remove snow and ice. Code Enforcement recommends the buiiding be repaired within 18Q days or removed within 15 days. Mr. Magner presented photographs of the properiy. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that this was referred by a Code Enforcement inspector that the building was vacant. The second floor windows were open, there was missing siding, there was tall grass and weeds and general dilapidation of the structure. The inspector opened a category II vacant building and issued a sumuiary abatement to the owner to secure the second floor windows which went to a work order for the boarding. Ms. Moermond asked Mr. Johnson and Mr. El Ba1ffi what there plans were for the building. Mr. El Balffi stated that the property had gone through extensive legal battles and he had only purchased the property a couple of months ago. At that time, he paid the vacant building fees and obtained the code compliance inspection. He had not paid the performance bond as he wanted to determine what the outcome would be from this hearing. He presented a work plan and financial documentation showing that he had the financing to do the work to the building. Ms. Moermond stated that she wanted to go back to the legal issues concerning the building. There had been 14 summazy abatement orders issued to the property, seven of which had gone to work order where the City was maintaining the property. Mr. Johnson stated that he had sold the property to a Selwin Ortega on a contract for deed in 2004 and he never paid or did anything with the property. He had indicated to Mr. Ortega that he needed to do something with the property. He then had to file a motion in court to cancel the contract for deed giving the property back to him which had occurred approximately three months ago. When he resumed possession of the property, he then sold it to Mr. El Bakri. Ms. Moermond stated that it appeared the sale of the property had occurred without the property ta7ces being paid for 2005-2006. Mr. El Bakri stated that he had purchased two properties from Mr. Johnson; one he had paid the back tases. He really did not want to take full responsibility of the financial issues with the property until all of the issues had been sorted out. 7uly 31, 2007 Legislative Hearing Minutes 0 7-�75 � Page 8 Mr. Johnson stated that he had paid the first half of 2007 real estate taaces and since Mr. Ortega had not paid for the taa�es in 2005 and 2006, he was going to sign an agreement with the County to pay for the owing tases on the properry. Ms. Moermond asked to review the work plan and financial plan from Mr. El Bakri. She asked Mr. EI Balffi to indicate the exact amount of financing he was willing to put towards the rehab of the property. She also requested more detail on the work plan and the bids that he received from the contractors. Mr. El Bakri stated that it was his intention to do a lot of the work himself. Mr. Johnson stated that he believed the County had accelerated the tax forfeiture process and wanted to make sure that there was a decision in his favor since today's date was the last day he had to pay the outstanding taxes. Ms. Moermond stated that a requirement for her granting additional time was that the ta�ces needed to be paid. Ms. Moermond recommended laying this matter over to the August 9 Legislative Hearing at 10:00 a.m. At that time, they would need to provide the following: 1) proof that the delinquent real estate taa�es have been paid; 2) additional contractor bids outlining the difference in the cost amount for the rehabilitation; 3) a timeline needs to be included in the work plan indicating when work is to be completed; 4) the $5,000 performance bond must be posted; and 5) the property must be maintained. Mr. Magner stated that he inspected the property on July 26 and noticed that trees and brush that had been cut away from the house were now laying in the rear of the property which needed to be removed. A summary abatement order was issued to remove the brush and tree limbs with a compliance date of August 3. There was also a board loose on a rear window which needed to be secured. Mr. Bala�i responded that most of the tree limbs and brush had been removed and he planned to remove the remainder the following day. Ms. Moermond stated that it was possible that the City Council may ask for monthly updates on the progress being made on the rehabilitation and they could recommend granting less than 180 days to bring the property into compliance. Ms. Moermond stated that she would make a recommendarion on the time to complete the repairs after she had a chance to review the revised work plan. Mr. Magner stated that the $5,000 performance bond had been posted, the vacant building fees had been paid and the registration form had been submitted, and the building and electrical pernuts had been pulled. He did not have the receipt showing that the tases had been paid, however, STAMP indicated that the back taxes had been paid and that the property was not at risk of forfeiture. Ms. Moermond stated that she had indicated to Mr. El Bal�i at the previous hearing that she needed to see a more detailed work plan outlining the timeline for completing the work, additional contractor bid information and the cost difference from his original work plan which showed the value of the work he intended to do himself. Ms. Moermond requested a letter be sent to Mr. El Balm outlining the conditions that needed to be met in order for her to recommend to the Council that they grant 180 days to rehabilitate the property.
