WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two-story, wood frame, duplex and wood frame shed located on property
hereinafter refened to as the "Subject Property" and commonly known as 733 CASE AVE .
This property is legally described as follows, to wit:
ARLINGTON HILLS ADDITION TO ST. PAUL 40/45 THRU 49 E 1 O FT OF LOT 17 AND
ALL OF LOT 18 BLK 18
WHEREAS, based upon the recoxds in the Ramsey County Recorder's Office and
information obtained by Departsnent of Safety and Inspections on or before October 25, 2006,
the following are the now known interested or responsible parties for the Subject Property: Mary
Brogdon, 1746 Stanford Avenue, St. Paul, MN SSi05;US Bank NA, 4801 Frederica Street,
Owensbaro, KY 42301; Usset & Weingarden, 4500 Pazk Glen Rd. #120, Mpls., MN 55416;

WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated May 11, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the shucture located on the Subject Property by June 11, 2007; and
WHEREAS, the enfarcement officer has posted a placazd on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the Ciry Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served norice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, July 31, 2007 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsibie parties to make the Subject Properiy safe and not detrimentai to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with ail applicable codes and ordinances, or in the alternative by

demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitarion or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
August 15, 2007 and the testimony and evidence inciuding the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 733 CASE AVE .

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then laiown
responsible parties to wrrect the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placazd on the 5ubject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitared by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in

accordance with all applicable codes and ordinances, or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
fifteen (15) days after the date of the Council Hearing.
2. If the above corrective acrion is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and chazge the costs incurred against tl�e
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legisiative
Code.
3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code

The building is a two-story, wood frame, duplex on a lot of 6,098 square feet.
According to our files, it has been a vacant building since November 16, 2006.
The cunent property owners are Mary Brogdon and US Bank, per AMANDA and Ramsey
county property records.
The City of St. Paul has boarded this building to secure it from trespass.

On May 1, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NiJISANCE BUILDING was posted on May 11, 2007 with a compliance date of
June 1 l, 2007. As of this date this property remains in a condition which comprises a nuisance as
defined by the legislarive code.
The Vacant Building registration fees are delinquent in the amount of $25Q.00.

Property Improvement, hereby deciares the premises located at:

On May Ol, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
�rst remedial action, a Code Compliance Inspection must be obtained from the
Building Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspecfion will identify specific defects, necessary
repairs and legat requirements to correct this nuisance condition. You may also be
required to post a five thousand doilar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and
shali not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a two-story, wood frame duplex with a wood frame shed.
Exterior
The window and/or door screens are missing, defective or in a state of disrepair.
Provide proper window and door screens for all openable windows and doors. Screens
must be tight-fitting and securely fastened to the frames.
The windows and/or storm windows are in a state of disrepair. Replace all missing or
broken window glass. Make all necessary repairs to frames, sashes, hardware and
associated trim in a professional manner. Permit may be required.
The exterior walls and/or trim of the garage has defective, peeled, flaked, scaled or
chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound
condition in a professional manner.
a. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects,
holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit
may be required.
The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
The exterior walls of the house and/or garage aze defective. Repair all holes, breaks,
loose or rotting siding, to a professional state of maintenance.
7. The stairs have missing or defective handrails. Provide all interior and exterior
stairways and steps of more that three (3) risers with handrails which are grippable and
installed 34" to 38" above the nose of the stair treads.
S. There are missing or defective guardrails. Provide ali stauways, porches, decks or
steps which are more than 30" high with guardraiis and intermediate rails with
openings in the guardrail no mare than four (4) inches apart and in accordance with the
State Building Code.
9. The reaz staircase is deteriorated.
10. Illegal and hazardous electrical drop (within 3 feet of openable window and rear
deck).

ll. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof
covering to a sound, tight and water impervious condition. Permit may be required.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by June 11, 2007 Neighborhood Housing
and Property Improvement, Division of Code Enforcement, will begin a substantial
abatement process to demolish and remove the building(s). The costs of this action,
including administrative costs and demolition costs will be assessed against the property
taxes as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth 5treet, Suite #200, Commerce
Building, (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to correct this nuisance condition.
As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subject to demolirion and removal by the City.
This placard shall not be removed without the written authority of the Department of
Neighborhood Housing and Property Improvement. . The deparhnent is further required to
file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessazy. The City Clerk
will then schedule dates for Public Heazings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.

If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

submitted:
BUILDING
l. Replace front steps from street sidewalk to porch. (build to code)
2. Rebuild front porch floor and straighten.
3. Rebuild rear eastside porch.
4. Move storage shed to meet zoning code.
5. Remove ali wall and ceiling covering and rebuild to code.
6. Insure one hour fire rating between units.
7. Rebuild reaz stairs to second floor unit. (rebuild to code)
8. Rebuild hasement stairs (closer to code} to be uniform.
9. Remove all floor covering and repair sub floor as needed.
10. In common entry way, replace all fire damaged materials.
11. Insure basement cellar floor is even, is cleanable, and all holes are filled.
12. Install plinth blocks under posts in basement.
13. Tuck Point interior/exterior foundation.
14. Install tempered glass in window on stair landing.
15. Provide thumb type dead bolts for all enhy doors. Remove any surface bolts.
16. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc. as necessary.
17. Provide storms and screens complete and in good repair for all door and window
openings.
18. Repair walls and ceilings throughout, as necessary.
19. Re-level structure as much as is practical.
20. Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards.
21. Prepare and paint interior and exterior as necessary (take the necessary precautions if
lead base paint is present).

Z2. Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly,
door and window openings that are not headered, etc.) are to be reconshucted as per
code.
23. Habitable rooms with new usage, replaced windows shall have glass area equal to 8%
of floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all
bedroom windows shall meet emergency egress requirements (20" wide minimuzn,
24" high minimusn but not less than 5.7 sq. ft. overall).
24. All charred members will have to be scraped or sandblasted completely clean and any
water warped members replaced. A determination as to necessary corrective
measures will have to be made by this department as to replacement, repairs, etc. All
smoked or charred members are to be sealed and deodoriaed.
25. Provide general clean-up of premise.
26. Provide smoke detectars as per the Minnesota State Building Code.
27. Repair soffit, fascia trim, etc. as necessary.
28. Provide proper drainage around house to direct water away from foundation.
29. Install downspouts and a complete gutter system as needed.

Ordering the owner to remove or repair the building(s) at 733 Case Avenue within fifteen (15)
days from adoption of resolurion.
Mr. Magner stated the building was a two-story, wood frame, duplex a lot of 6,098 square feet and had
been vacant since November 16, 2006. A code compliance inspection had been done on July 19, 2007.
The vacant building registration fees were delinquent in the amount of $250 and the $5,000
performance bond had not been posted. . On May 1, 2007, an inspection of the building was done and
a list of deficiencies which consritute a nuisance condition was developed. An order to abate a
nuisance building was posted on May 11, 2007 with a compliance date of June 11, 2007. To date, the
property remained in a condirion which comprised a nuisance as defrned by the Legislative Code.
Ramsey County T�ation estimated the market value of the land to be approximately $50,000 and the
building to be $75,000. Real estate taaces for were current. Code Enforcement esrimates the cost to
repair the building to be appmximately $80,000 to $90,000. The cost for demolition was estimated to
be approximately $9,000 to $10,000. There had also been 10 summary abatements issued to this
property nine of which went to work order: to secure the building and the City had to board the
building to secure it from trespass, remove improperly stored refuse, remove tall gxass and weeds and
remove snow and ice. Mr. Magner stated that there had been a fire at the building on November 16,
2006 and the City has had to board the building several times. The building has been broken into a
number of times and he had information that there was a homeless person living in the backyard. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
The property owners of record, Mary Brogdon and US Bank, did not appear. Wally Nelson appeared
as a person of interest on this property.
Ms. Moermond stated that after hearing the staff report concerning the condition of this property, she
recommended the building be removed within five days with no option for repair.

Bashir Moghal, the property owner, appeared.
Ms. Moermond stated that this matter was heazd on July 31 and asked Mr. Magner to read his report
into the record again. Mr. Ma�er stated that the vacant building registration fees were paid on August
9, 2007 and Mr. Moghal also frlled out the vacant building registration form. The performance bond
was posted on August 6, 2007 and permits were pulled that day. He had talked to Mr. Moghal that
morning and he indicated that it was his intention to rehabilitate the building and he instructed him that
he should attend this hearing.
Ms. Moermond asked Mr. Moghal when he had purchased the property. Mr. Moghal stated that he
purchased the property the first week of August. He apologized for not having a copy of his Purchase
Agreement as he was in a hurry to get to this hearing. He had pulled a building permit and was in the
process of obtaining bids for heating, electrical and plumbing and explained that he had worked with
the licensed contractors on previous projects and knew that they did good work. He had gotten a
dumpster and cleaned the building inside and out. He had already purchased new windows, new
doors, had gotten sheetrock, and plywood. He had obtained financing through Inter Bank and believed
that he would be able to complete the rehabilitation in approximately three months.
Ms. Moermond stated that she would like to review the plan before she would recommend to the City
Council that they give him time to complete the project. The Public Hearing on this matter was
scheduled for August 15 at 530. At that time, she would request that the City Council conrinue the
hearing to September 5. Prior to the hearing on September 5, she would require Mr. Moghal put
together a work plan with specific timelines and a copy of the bids he received. She would also require
financial documentation showing that he had the financial ability to complete the rehabilitarion.
Mr. Moghal asked if he should attend the Public Hearing on August 15. Ms. Moermond responded
that she thought it would be in his best interest to attend the hearing.
