RESOLVED, That the proper City officers are hereby
authorized and directed to pay out of the proper funds of the
City of Saint Paul, $750.00 as follows: the sum of $375.00 to
Ruth Reid, individually, and $375.00 to Ruth.Reid and Edward Speer
Reid, as Executors of the Estate of Harold S. Reid, deceased, upon
their delivery of grants of easement, approved by the Corporation
Counsel, on part of Lot 1, Block 2, Dunlap Place Addition, for the
period from January 1, 1962, to July 1, 1963, said easement being
for the purpose of facilitating construction of a bridge over
St. Clair Avenue.

On January 16, 1962, the undersigned were requested by the City Council
to study and make a recommendation concerning a request for damages as
submitted by Mr. John E. Nielsen of 1443 Edgerton Street resulting from
the grading of Arlington Avenue from Edgerton Street to Westminster
Street in accordance with Final Order C.-F. No. 198480, approved
August 16, 1960. Easements necessary for the slopes of this project
were condemned as per Final Order C• :F. No. 198481, approved August 16,
1960.
Mr. Nielsen's property is located on the northwest corner of Edgerton
Street and Arlington Avenue and is legally described as Lots 9, 10, and
11, Block 4, Farrar's Addition to the City of St. Paul, Ramsey County,
Minnesota.
The slope plan, as referred to in the final order in the condemnation
of the slopes, was in error insofar as it didn't indicate any cut on
Mr. Nielsen's property. Because of this inadvertent omission, Mr.
Nielsen did not receive an award of damages for slopes. In the actual
field grading of Arlington, it was necessary to make a cut extending
a distance of about two feet into Mr. Nielsen's property with said out
being made northward from the north line of Arlington. The end of the
out came quite close to Mr. Nielsen's dwelling and this necessitated
the construction of a cement block retaining wall by Mr. Nielsen.
The undersigned mutually feel that Mr. Nielsen's request for an award
of $464.00 to completely satisfy his claim is fair and just. We, there-
fore, recommend that the Corporation Counsel be instructed to prepare
the necessary council resolution authorizing the payment of $464.00 to
Mr. Nielsen.
