AGNES H. O'CONNELL City Clerk HAROLD J. RIORDAN Council Recorder Dear Sir: t The City Council requested that you prepare a resolution awarding John E. Nielsen, 1443 Edgerton St., $464.00 for damages resulting from the grading of Arlington Ave. from Edgerton St. to Westminster St., as more fully described in the attached letter of Eltor A. Dehn and Eugene V. Avery. i Very truly yours, itv Clerk Q i '20 ,59g CITY OF SAINT PAUL - MINNESOTA 8 f r t r I, LEONE b C. SEAMER,- Valuation Engineer. ° ELTQJt A. Vavoulis, Mayor and Members of the City Council City of Saint Paul Gentlemen: CApital 4 -4612 On January 16, 1962, the undersigned were requested by the City Council to study and make a recommendation concerning a request for damages as submitted by Mr. John E. Nielsen of 1443 Edgerton Street resulting from the grading of Arlington Avenue from Edgerton Street to Westminster Street in accordance with Final Order C.-F. No. 198480, approved August 16, 1960. Easements necessary for the slopes of this project were condemned as per Final Order C• :F. No. 198481, approved August 16, 1960. Mr. Nielsen's property is located on the northwest corner of Edgerton Street and Arlington Avenue and is legally described as Lots 9, 10, and 11, Block 4, Farrar's Addition to the City of St. Paul, Ramsey County, Minnesota. The slope plan, as referred to in the final order in the condemnation of the slopes, was in error insofar as it didn't indicate any cut on Mr. Nielsen's property. Because of this inadvertent omission, Mr. Nielsen did not receive an award of damages for slopes. In the actual field grading of Arlington, it was necessary to make a cut extending a distance of about two feet into Mr. Nielsen's property with said out being made northward from the north line of Arlington. The end of the out came quite close to Mr. Nielsen's dwelling and this necessitated the construction of a cement block retaining wall by Mr. Nielsen. The undersigned mutually feel that Mr. Nielsen's request for an award of $464.00 to completely satisfy his claim is fair and just. We, there- fore, recommend that the Corporation Counsel be instructed to prepare the necessary council resolution authorizing the payment of $464.00 to Mr. Nielsen. A r e4A!
