THIS_ IS AN EMERGENCY ORDINANCE RENDERED NECES- SARY FOR THE PRESERVATION OF THE PUBLIC PEACE, HEALTH, AND SAFETY. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertain- ing to Use Districts, Height Districts, and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from Light Industry District to "C" Residence District, to -wit: Lots 1 through 8, Block 7, St Anthony Park West, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota, being located on the west side of Eustis Street between Chilcombe and Doswell Avenue. Section 2. This ordinance is hereby declared to " be an emergency ordinance rendered necessary for the preserva- tion of the public peace, health and safety. Section 3. This ordinance shall take effect and be in force upon its passage, approval and publication. City Clerk Building Dear Madam: 113 CITY HALL AND COURT HOUSE O'Connell SAINT PAUL Z, MINNISOTA ,y February 8, 1962 This is a petition of Robert`Sboffner to rezone from Light Industry to a 11 C" residence district property located on the west side of Eustis Street between Chilcombe and Doswell Avenues. The property is described as Lots 1 through 8, Block 7, St.Anthony Park West. The property is zoned Light Industry and has been since the enactment of the Zoning Ordinance in 1922. On January 2, 1962, the Commissioner of Finance reported the petition sufficient with the owners of 7 of a possible 8 (87.5%) tracts of land within the prescribed 100 foot radius having signed the petition. This block consists of eight platted lots and is divided into three separate ownerships. It is developed with one two- family residence constructed in 1958 which takes its frontage off Doswell Avenue, one very old single - family residence which fronts on Eustis Street, and one large residence which -bas been converted into a multi- residence use and which fronts on Eustis Street. This block has a frontage along Eustis Street of 354 feet and 110 feet along both Doswell and Cbilcomb Avenues, resulting in a total area of 39,382 square feet.. The purpose of the petition is to preserve the character of the pre- sent neighborhood uses which are single and two - family uses with the exception of an office building north across Cbilcombe Avenue and the right -of -way of Trunk Highway 280 to the west. The Board of Zoning considered this matter at their regular meeting on January 18, 1962, and it is the Board's opinion that the reclassification of this property to a "C" residence district would be a decided upgrading of the present light industry classification. Therefore, the Board of Zoning recommends the granting of the petition to rezone the above described property from a light industry district to a "C" residence district. JCW :FGI Encl.
