WHEREAS, Francis W. Whalen was in the employ of the
Department of Public Works on and prior to August 9, '1960
in thecapacity of a truck driver at a weekly wage of $108.00
plus an allowance for use of his truck, and while having his
truck repaired he sustained a personal injury on that date; and
WHEREAS', Francis W. Whalen petitioned the Industrial
Commission of Minnesota for compensation and medical expense
by reason of said personal injury, his claim being disputed
by the City, a hearing was held by the Commission and the
Commission has filed its Findings and Determination in this
matter on January 4, 1962, a copy of which is hereto attached
and made a part hereof by ref erence,
Now, therefore, be it
RESOLVED, That the proper City officers are hereby
authorized and directed to make compliance with said decision
of the Commission and to make the following payments as directed
by the Commission: To the employee, compensation at the rate -of
$45.00-per week for a period of 32 and 3/5 weeks of temporary
total disability, or $1467.00, plus the sum of $825.89 representing
two - thirds of the wage loss sustained by the employee through
~ November-22, 1960, or the sum of $2292.89; plus the sum of $722.65
as reimbursement for medical expense incurred by the employee,
or a total sum of $3,015.54; also, to pay the unpaid bills of
St. Luke's Hospital in the sum of $795.05 and to Dr. George T.
Wier, the sum of $450.00; also, to pay to Robins, Davis & Lyons,
attorneys for the employee, attorneys fees of 25 per cent of the
compensation recovered by the employee, or the sum of $573.22
and said sum shall be deducted from the total compensation
received by employee, leaving a balance due pand payable to
the employee of $2,442.32.
