t WHEREAS, the Court of Appeals for the State of Minnesota has issued a Writ of Certiorari to the City Clerk
2 of the City of Saint Paul regazding Council File No. 07-648 regarding the demolirion of 80 Sycamore St.E,
3 Saint Paul, Minnesota (hereinafter "Property") and has the authority to stay the enforcement of the Council
4 Resolution to protect the subject matter of the appeal pursued by Access Bank, Inc (hereinafter "Petitioner");
5 and
� WHEREAS, the same Peritioner has also requested the Saint Paul City Council stay execution of Resolurion
8 No. 07-648; and
10 WHEREAS, the Court of Appeals in the past has remanded a Certiorari Appeal back to the City Council to
I 1 impose reasonable tern�s and conditions of a stay pending appeal and the City wishes to avoid further delays in
12 the abatement action; and

t4 WHEREAS, the Saint Paul City Council found that the Property constitutes a public nuisance pursuant to
ts Saint Paul Legislative Code Section 45 and is subject to demolirion; and

17 WHEREAS, since January 2, 2007, the property has been vacant and on March 2, 2007 a building inspection
t 8 determined that the Property consrituted a nuisance condirion. On April 10, 2007 an order to abate the nuisance
19 was posted with a compliance date of Apri125, 2007.

21 WHEREAS, the City of Saint Paul has needed to issue several suinmary abatement orders to boazd the
22 building to secure it from trespass, remove improperly stored refuse and remove snow and ice for public safery;
23 and

z5 WHEREAS, after proper notice pursuant to Saint Paul Legislarive Code Section 45, neither the property owner
z6 of record nor any other interested or responsible parties appeared at the legislative hearing to discuss correcrion
2� of the code violarions or any remedial action to preserve the health and safety of the neighborhood; and

29 WHEREAS, the City risks claims for damages arising out of this nuisance condition;

31 NOW, THEREFORE, BE IT RESOLVED, that the City Council will stay the enforcement of its resolution to
32 demolish the Properry upon the following reasonable terms and condirions which it finds will adequately protect the
33 health and safety of the City and its citizens:

35 First: Petifioner shall be responsible for the exterior maintenance and security of the Property, including the
36 designation of a local agent who will be preauthorized and required by the same to respond and correct any
37 code violations as requested by a city inspector, without the need for any written correction notice or
38 abatement order, as soon as possible and in no event longer than 48 hours; and
39
40 Second, Petirioner will post with the City of Saint Paul a supersedeas bond in the amount of $5,000 (five
41 thousand dollars and no cents) to be used to offset any claims against the City of Saint Paul. The bond will be
4z returned to the Petirioner if they are successful with the Writ of Certiorari, and;

information obtained by Department of Safery and 7nspections on or before October 25,

that the structure located on the Subject Properiy is a ttuisance building(s) pursuant to

after receiving tesiimony and evidence, made the recommenciation to appmve the request
to order the inferestefl or responsible parties to make fhe Subj ect ProgerEy safe and not
deirime�tai ta the pub&c peace, health, safety aad welfare aad remove its hlighting
influence on the community by demolishing and remov�g fhe suucture in accordsnce
with all applicable codes and ordinances. `The demolition of the sfruciure to be

V3HEREAS, a hearing was heid before the Saint Paul City Council on
Wednesday, Juiy 18, 2007 and the testunony and evidence including the action taken by
the Legislative FEearing Officer was considered by the Council; now therefore
BE TT RESOLVED, that hased upon the testimony and evidence presented at the
above referenced pubLic hearings, the Saint Paul City Council hereby adapts the
following Fin@ings and Order concerning the Subject Property at 80 SYCAMOT2E
STREET EAST.
That the Subject Property camprises a nuisance condirion as de&ned in
Saint Paul I,egislative Code, Chapter 45.

exceed five thousand dollars {$5,000.00).
That there now �ists and has existed multiple FIousang ar Buiiding code
vio2ations at the Subject Property.

responsible parties to correct the deficiencies or to demolish and remave
the building(s).
5. That the deficiencies causing this nuisance condition hav e not been
conected.

2. If ti�e above conective action is not oompieted within this period of time
Department of Safety and Inspections is hereby anthorized to take whatever steps
are necessary ta demolish and remove this shuctiue, fi11 the site and charge the
costs incurred against the Subject Property pursuant to the provisions of Chapter
45 of the Saint Paul Le�slative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul,
all personal property or fixtures af any kind which interfere with the demolition and
removal shalI be removed from the properiy by the responsible parkies by the end of
this time period. If alI personal property is not removecl, zt shall be considered to be
abandoned and the City of 5aint Pau1 skall remove and dispose of such property as
pmvided by law.
4. It is further ordered, that a cogy of this resolution be mailed to the owners and
interested parties in accordance with Chapter 45 ofthe Saint Paul Legislative Code.

The property was reinspected on May_23, 20Q7. There was no compliance and the
nnisance condition remains unabated, the commuzuty continues to snffer the blighting
influence of this property. Tt is the recommendation of the Deparknent of Safety and
Inspections thaz the City Councii pass a resolution ordering the resgonsible parties to
either repair, ar demolish and remove Yhis building in a timely manner, and failing that,
authorize the Depariment of Safety and Inspections to proceed to demolition and removal,
and to assess the costs incurred against tkte real estate as a special assessment to be
collected in the same manner as taaces.

porches, decks or steps which aze more than 30" high with guardrails
and intermeciiate rails with openings in the guardrail no more thxa foua
(4) inches apart and in accordance wifh the State Building Code.
3. 3'he stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails
wkich are grippable and installed 34" to 38" above the nose of the stair
traads.
4. The interior eeilings aze defective. Repair alI ceiling defects and finish
in a professional manner.

6. SANITATIOI3: Immediately remove improperly stored or accumulated

Mr. Maguet sfated the building was a two-story, wood frame, duplex on a lot of 4,356 sqvare feet and
had been vacant since 7anuary 2, 2007. A code compliance inspection had not been done the vacant
building registrahon fees were delinquent in the amount of $250 an@ the $S,QQO performance bond had
not been posted. . On March 2, 2007, an inspection of the building was done and a list of deficiencies
which constitute a nuisance wndition uras developed. An order ta abate a nuisance building was
posted on ApriI I0, 2047 with a compliance date of Apri125, 2007. To date, fhe progerty remained in
a condition which camprised a nuisance as defined by the Legislative Code. Ramsey County Tasation
estimated the market value of the land to be approximately $52,$00 and the building to be $151,500.
Rea1 esEate tases were current. Code Enforcement esiamates ihe cost to repair the building to be
appro�mately $50,000 to $75,OOD. The cost for demolifion was estimated to be approximately $8,000
to $10,000. There had also been four suuunary abatements, some with multiple violations, issued to
this property six of w3uch went to work order: to secure the building and the City had to boazd the
building to secure it from irespass, remove improperly stored refuse, remove snow and ice. Code
Enforcement recommends the buiIding be repaired or removed within 15 days. Mr. Magner also
referenced an e-mail he received from Kerry Antrirn, District 6 Platming Council, on the desire to have
the building demolished. Mr. Magner presented photographs of the properiy.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that they
became aware that this was a vacant buitding during a fieid find.
The properiy owner of record, Robert Pascavage/Tritec Leasing, did not appeaz. No other parties of
interest appeared.
Ms. Moermond recommendeti the building be removed within 15 days with no oprion for repair.
