V — OFFICE OF THE C'ye of the Board of Water Commis - ners of the City of Saint Paul, was c � ured in a third party accident on O N TION —� tember 23, 4980, and -the Board has t6,ended on behalf of said employe aVmedical expense -iahe t.- -•P $94P PRESENTED BY j i lias pa `r' w; _ + ±ta " !'Ra COMMISSIONS;,• e p 6i3 i a° WHEREAS, Mathew Morelli, an employe of the Board of Water Commissioners of the City of Saint Paul, was injured in a third party accident on September 23, 1960, and the Boai1 has expended on behalf of said employe for medical expense the sum of $948.45 and has paid workmen's compensation to said employe in the sum of $333.00, making a total expenditure of $1281.45; and WHEREAS, a settlement has been negotiated as between the employe and the third party involved in said accident, Lake St. Sash and Door Co., through employe's attorneys, Orren and Griswold, in the total amount of $4250.00, to include the subrogation interest of the City and Board; and WHEREAS, the office of the Corporation Counsel is in possession of a draft drawn on Great Northern Insurance Company of Minneapolis, Minnesota, No. 154345, upon the First National Bank of Minneapolis, to the order of Mathew N. Morelli., City of St. Paul, Minnesota, and Orren and Griswold, their attorneys, in the amount of $4,250.00; and that when said draft is negotiated, the City on behalf of the Board will be reimbursed for its full subrogation interest, $1281.45, less attorney's -fees of one - fourth or $320.36, leaving a net recovery for the City and Board of $961.09; now, theref ore, be it RESOLVED, That the proper City officers are hereby authorized to endorse said draft, on behalf of the City and the Board, and to forward the same to employe's attorneys, Orren and Griswold, so that said draft may be negotiated and payment made to the City, on behalf of the Board and credited to the Water Depart- ment Fund, in the sum of $961.09, said payment to constitute full, final and complete settlement of the City and Board's subrogation interest on account of the injury of its employe, Mathew Morelli; FURTHER RESOLVED, That the proper City officers are hereby authorized to execute any necessary releases pertaining to said subrogation settlement.
