WHEREAS, The plans and specifications for the construction of a sewer
in Hoyt Avenue from Sloan Street to a point 712 feet west of the center
line of Sloan Street and in Wheelock Parkway from Sloan Street to a point
850 feet west of the center line of Sloan Street were approved by the
City Council on September 18, 1958, C.F. 189206; and

WHEREAS,�The Department of Public Works reports that construction
undertaken by the Minnesota Highway Department on Inter -State Highway 35E
has changed the ground and surface condition to the extent that the sewer
in Hoyt Avenue between a point 406 feet ewest of the center line of Sloan
Street and a point 712 feet west of the center line of Sloan Street can
no longer be constructed according to the plan approved by the Council,
therefore, be it
RESOLVED, That, upon recommendation of the Department of Public Works
the order approving these plans on September 18,.1958, C.F. 189206, be
amlt�ended so that the portion of the sewer on Hoyt Avenue from a point
406 feet west of the center line of Sloan Street to a point 712 feet
west of the center line of Sloan Street be deleted from the plans and
specifications for the total improvement, }as described above and known
as Public Works Project No. 58 -S -757 and, that the deleted portion be
redesigned and submitted to the Council'as a separate and distinct project
for approval at a later date.
