and indemnification being found on Pages 1 -13 through
1 -17 of the Specifications for Street and Sewer Con-
struction as amended, copies of which specifications
are on file in the office of the Commissioner of
Public Works, and the provisions of such specifications
relating to insurance and indemnification are incorporated
herein and made a part hereof as though fully set forth
herein.
3. Said permittee shall file with said City a
performance bond in the amount of Ten Thousand Dollars
($10,000) in a form and with sureties acceptable to
the City of Saint Paul, and said bond to be conditioned
upon said permittee's full and faithful performance of
the obligations herein undertaken.
4. Said permittee shall, upon written notice from
the Commissioner of Public Works, forthwith remove
said slopes from the locations herein authorized and
shall promptly restore said property to the satisfaction
of the Commissioner of Public Works at no cost to the City
of Saint Paul.
5. This -permission and authority shall become effective
only after said permittee shall have filed in the office
of the City-Clerk its written acceptance of the conditions
and obligations herein contained, and in connection there-
with, the City Clerk is hereby directed to forward to said
permittee a copy of this resolution, assent to which by
said permittee is a prerequisite to its effectiveness.

RESOLVED, upon the report and recommendation of the
Commissioner of Public'Works, that permission is hereby granted
to the Housing and Redevelopment Authority of the City of
Saint Paul to place certain fill slopes inside the property
line of Livingston Street in connection with certain projects
being constructed by said Authority on adjacent land, the
description of said property within which construction of
slopes is herein authorized being as follows:
The easterly 10 feet of Livingston Ave. abutting
Lot 1, Block 153, and Lots 4 and 5, Block 151,
West St. Paul Proper. A strip of land 10 feet
in width and 50 feet north of Curtice Street on
the west property line of Livingston Street
and a strip of land 10 feet in width and t60
feet in length south and abutting the west
property line of Curtice Street, all as shown ibn
the attached sketch;
the conditions upon which said permission and authority are
herewith granted being as follows:
1. Said permittee shall pay to the City of Saint
Paul all engineering costs incurred by said City in
the design and construction of said slopes within
the limits as aforesaid.
2. Said permittee shall agree to fully and completely
indemnify and defend and hold harmless the City of Saint
Paul, its agents, servants and employees from any and all
liability arising out of or occasioned by the construc-
tion of the slopes as aforesaid, and in connection
therewith, said permittee shall file with and maintain
policies of insurance in conformity with the insurance
requirements of the General S'pecifickations for Street
and Sewer Construction of the City of Saint Paul,
Minnesota, said specifications relating to insurance
