O'Connell City Clerk Building Dear Madam; This is in the matter of the appeal of S. M. Burton to relax the lot frontage requirement for single - family residential development in a "B" residence district to permit him to erect a single - family residence on property wbicb is located on the south side of Taylor Avenue between Fry Street and Snelling Avenue and is described as the east 37.7 feet of Lot 13, Block 6, College Place Taylor's Division. A copy of a registered land survey submitted by the applicant discloses that he owns 40 feet of frontage of Lot 13. It further discloses that the existing residence to the west is within 1.7 feet of the mutual property line and it is therefore necessary that the applicant convey 2.3 feet of his lot width to the adjoining property so that said exist- ing residence will comply with the minimum 4 foot side yard requirement of the Building Code. Because of this required conveyance the appli- cant's lot frontage is thereby reduced to 37.7 feet. The Zoning Code requires a 40 foot minimum lot width for single - family residence use, and it is therefore necessary that the applicant secure a variance of this requirement from the City Council before a building permit can be issued. Field investigation discloses no objection to the requested relaxation as the applicant proposes to develop the property with a single - family residence 28 feet in width which would provide side yard set backs of approximately 5 feet. It should also be pointed out that the lot area of the subject property exceeds the minimum requirement by 2,400 square feet. The applicant has also been advised that it would be necessary to secure an easement across the rear of the adjoining property to the west for the purpose of providing ingress and egress for off- street parking purposes, a copy of this easement has been provided. It does not appear that said relaxation would be detrimental to the adjoining uses. In consideration of the above factors, the Board of Zoning recommends the granting of tbe'appeal to relax the minimum frontage on the above described property to 37.7 feet as requested. HCW;FGI Encl.
