PA fomY ndation of the Commissioner of Public works, that permission is hereby OFFICAOF THE CI O. granted to Ashbach Construction Corn- "my to use ceftain dead -end streets l) OUNCIL LUTION —G ;-A alleys adi:,i�ent to the proposed, }�li'Y•,} ' �£', T r }! _d ^ right -of= • • (�� � .1k :.al ng DAT u RESOLVED, upon the report and recommendation of the Commissioner of " Public Works, that permission is hereby granted to Ashbach Construction Company to use certain dead -end streets and alleys adjacent to the proposed St. Anthony- Rondo Freeway right -of -way, for the purpose of installing on •a temporary basis a portable concrete dry batch plant for use in connection with construction of certain public roads in the :area, the location'-for which permission is granted being described as follows: Wheeler Street from the north right -of -way line produced of the Chicago, Milwaukee, St. Paul & Pacific Railway to the north line produced of Lot 9, Block 3, 'Qui.nby Park; Roblyn Avenue,-the area bounded by the west property'line of Wheeler Street, the north property line of Roblyn Avenue, -and the north right -of -way line produced of the Chicago; Milwaukee, St. Paul & Pacific Railway; That portion of the north -south alley in Block 3, - Quinby Park located between the north property line of Roblyn—Avenue—and the north line produced of Lot 9, Block 3; and including solely for purposes of access to the above described property, that portion of Wheeler Street from the south property line of St. Anthony to the north line produced of Lot 9, Block 3, Quinby Park. The conditions upon which said permission is hereby granted shall be av follows: 1. The area involved is situated adjacent to Roblyn and Wheeler Streets in the St. Anthony -Rondo Freeway right -of -way. As the.property itself is under the jurisdiction of the Minnesota Highway Department, it was necessary for us to deal with the Land and Right -of -Way Section at the Highway Department. We began negotiations with the Highway Department in June of 1962. After about a month of correspondence and visits to the Department, they informed us that they did not, as of that time, have control of the streets in this area and we would have to obtain permission for their use from the City of Saint Paul; further, until this was complete, they would not be able to lease us the ground necessary for our concrete batching plant. After receiving this information, we immediately proceeded to get a permit for this operation and streets involved from the Department of Public Works. As you know, the resolution was adopted the 27th of July, 1962. However., such a long time had elapsed from early June, when we began negotiating with the Highway Department, to late July, and as we still did not have a lease from the State for this property, we decided we could no longer wait for this location and consequently set up our plant in another location. We thank the City Council, the Department of Public Works, and all others who had a hand in approving our request for this Permit.
