THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby given to Ruth Reid
individually and as representative of the Estate of Harold S. Reid, to grade and
surface with bituminous material Stanford - Avenue from Griggs Street east 120 feet
to the western boundary of Lot 15, Block 1, Dunlap Place Addition, and the Commis-
sioner of Public Yorks is hereby authorized to issue .a. permit therefor to said
Ruth Reid individually and as representative of the Estate of Harold S. Reid, upon
her compliance with the following conditions, viz:
1. Said permittee shall grade said section of street and surface same
with bituminous material at her own cost and expense, and to the satisfaction and
under the supervision of the Commissioner of Public Vorks, and in+ accordance with
plans and specifications of the Department of Public Vorks.
2. Said permittee shall pay the cost of engineering and inspection end
also the cost of publication of this ordinance.
3. Before entering upon or doing any of said work, said permittee shall
procure from the abutting owners such easements in and to the abutting property
as may be necessary for slopes, - cuts.and fills, and shall obtain a written release
from such owners, releasing:and discharging the City from any and all damages by
reason of the grading and surfacing of said section of street.
1+. Said permittee shall properly protect all excavations made in any
subject section of street, both day and night, so as to avoid all damage or injury
to person or property, and shall properly fill and tamp any subject section of
street to avoid settling.
5. Said permittee, ,after the inception of said work, shall prosecute
the same continuously, with diligence, and complete said work on or before
September 1, 1961+.
6. Said permittee shall furnish.a bond of $10,000 to the City of Saint
- Paul, conditioned to comply with all the terms of this ordinance, :and to indemnify
and save the City harmless from any and all loss, liability, judgments, suits, costs,
charges, damages or expense that may ;accrue to person or property occasioned by the
grading and surfacing of said section of street.

and hold harmless the Cityof Saint Paul, its agents, officers and'employees from any
and all damages, claims, losses, judgments, suits, or expenses - arising out of or
occasioned by the performance of the work contemplated by this permission and authority.
S. Said permittee shall not proceed with said work unless and until said
permittee shall have fully complied with the provisions regarding insurance and indem
nification contained in the Cit7 of Saint Paul Department of Public Works Specifications
for Street and Sewer Construction, dated April 1, 1959, as -amended, Section 1.4./+,. and
found on pages 1 -13 through 1 -17 of said Specifications applicable to contractors.
For the purposes of this•,ordi.nance, the aforesaid section of said Specifications
numbered 1.44, as -amended, shall read as though the word " permittee" were substituted
for the word "contractor" wherever the same appears in the aforesaid Section 1.44: Said
Section 1.4+J of the Specifications for Street and Sewer Construction in the City of .
Saint Paul,�as• amended, is hereby incorporated herein by reference as fully and as
completely as if set forth herein verbatim. Proof of compliance with the provisions of
the aforesaid Snotion t. U+ shall be in such form' as • the Corporation Counsel of the '
City of Saint Pr:.ul may direct ,-nd the documents required by the aforesaid Section 1.14
shall, after submission to the Corporation Counsel, be filed in the office of the
Comptroller of the City of Saint Paul..
9. Said permittee shall, within 30 days•a.fter the passage of this ordinance,
file a written acceptance thereof with the City Clerk.
Section 2. This ordinance is hereby declared to be an emergency ordinance
rendered necessary for the preservation of the public peace, health, and safety.
Section 3. This ordinance shall take effect and be in force upon its
passage, :approval, 'and publication.

An Urdinance amending i,hapter "7A of

therein inserted by an amendment to said Legislative
code of the bit, of Saint Paul by virtue of Urdinance
No. 12122, approved -jzanuary 11., 1962, ,and containing
provisions therefor and prohibitind' certain business
activities on Sunday, defining the violations thereof
as misdemeanors .and providing the_ punishment to be..
imposed for such, violations, as "amended, by inserting
therein .an additional provision-expressly excepting
therefrom the exhibition --for sale and sale of
merchandise at any public Merchandise Exposition 'at
any duly established hotel or, auditorium. This is an
emergency ordinance rendered necessary for the preser-
vation of the public peace, health, and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES OIRMIN:
Section 1. That Chapter "7A of the Legislative Code of'the City
of Saint Paul,•therein inserted by -an amendment to said Legislative Code of the
City of Saint Paul by virtue of Ordinance No. 12122, approved' January /., 1962,
and containing provisions therefor.and prohibiting certain business activities
on Sunday, defining the violations thereof as misdemeanors and providing the
hment to be imposed for such violations, as .amended, hereby is further
ed in the following particulars, to wit, that the language therein con -

"Nevertheless, no provision of this Ordinance shall
be construed to prohibit the retail sale at ally such -
publia place of merchandise essential to, customarily
sold at, or incidental to the operation of any public
auditorium, bathing beach, amusement park_, or sports
arena, nor to prohibit the dispensing of any coupon,
stamp or merchandise premium in conjunction and
simultaneously with the sale of any merchandise not
prohibited by this Ordinance nor to prohibit anry ed-
vertisemenis for sale of any merchandise by any newspaper
or other established advertising medium nor to prohibit
any occasional or isolated sale of merchandise in any
transaction conducted on any private premises and
disassociated with.dny regularly established business,
nor to -prohibit the retail sale of packaged ice milk or
packaged ice cream.n
hereby is amended to read as follows:

Short Line Road the City is in the process of condeming the
following part of our property:
All of Lots 11 2, 3, 4, and 5 and
part of Lot 6, Block 1, Dunlap
Place Addition;
All of Lots 1, 2, 3, 4, and 5 and
part of Lot 6, Block 2, Dunlap
Place Addition.
Condemnation of the latter described property will
deprive us in part of our former access to St. Clair Avenue.
As a result it would be very advantageous for us to open up
Stanford Avenue so as to connect our property with Griggs
Street. Accordingly, we request permission to open and grade

Stanford Avenue from the eastern boundary of Griggs Street
as platted east 120 feet to the western boundary of Lot 15,
Block 1, Dunlap Place Addition at our own cost and expense
according to plans and specifications to be prepared by
the City.
We agree to pay all engineering and inspection
costs in connection with this work.
We also agree to furnish bond to the City in
such form as may be approved by the Corper ation Counsel
and in such amount as may be determined by the City Council,
agreeing to be bound by the terms of the Ordinance granting
us permission to do this work.
We request that we be given until September 1,
1961„ to complete this work.
