1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a two-story, wood frame, single family dwelling and a detached, one-stall gazage
4 located on property hereinafter referred to as the "Subject Property" and commonly lrnown as
5 1073 EARL ST . This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before October 25, 2006,
the following are the now known interested or responsible parties far the Subject Property: JP

WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated Apri124, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
ar demolish the structure located on the Subject Property by May 24, 2007; and
WHEREAS, the enforcement officer has posted a placazd on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the Ciry Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served norice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, July 17, 2007 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
August 1, 2007 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1073 EARI. ST.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolifion and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to conect the deficiencies or to demolish and remove the
building(s).
5. That the defrciencies causing this nuisance condition have not been corrected.
6. That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subj ect to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes tlte following order:

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject
Property safe and not detrimental to the public peace, health, safety and welfare
and remove its blighting influence on the community by rehabilitating this
shucture and correcting all deficiencies as prescribed in the above referenced
Order to Abate Nuisance Building(s) in accordance with all applicable codes and
ordinances, or in the altemative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within r����
one hundred-ei�hty (1801 days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time
Department of Safety and Inspections is hereby authorized to take whatever steps
are necessary to demolish and remove this structure, fill the site and charge the
costs incurred against the Subject Property pursuant to the provisions of Chapter
45 of the Saint Paul Legislative Code.
In the event the building is to be demolished and removed by the City of Saint
Paul, all personal property or fixtures of any kind which interfere with the
demolition and removal shall be removed from the property by the responsible
parties by the end of this time period. If all personal property is not removed, it
shall be considered to be abandoned and the City of Saint Paul shall remove and
dispose of such property as provided by law.
It is further ordered, that a copy of this resolurion be mailed to the owners and
interested parties in accordance with Chapter 45 of the Saint Paul Legislative
Code.

The building is a two-story, wood frame, single family dweliing with a detached single stall
garage on a lot of 4,792 square feet.
According to our files, it has been a vacant building since Februazy 13, 2006.
The current property owners are JP Morgan Chase Bank, per AMANDA and Ramsey county
property records.
The city has had to board this building to secure it from trespass.
There have been seven (7) SUMMARY ABATEMENT NOTICES since 2006.
There have been ten (10) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall �ass and weeds
- Removal of snow and ice
- Board up building
On April 11, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ASATE A NCTISANCE BUILDING was posted on Apri124, 2007 with a compliance date of
May 24, 2007. As of this date this property remains in a condition which comprises a nuisance as
defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $375.00.
Taxation has placed an estimated market value of $42,800 on the land and $116,900 on the
building.
As of March � 2006, a Code Compliance inspection has.a�-been completed.
As of July 13, 2007, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $20,000 to $40,000. The
estimated cost to Demolish is $10,000 to $12,000.

Dear: Sir or Madam
The VacanUNuisance Buildings Unit, Department of Neighborhood Housing and
Property Improvement, hereby declares the premises located at:
1073 EARL ST
and legally described as follows, to wit: DOUGLAS ADDITION TO SAINT PAUL S
40 FT OF THE N 85 FT OF LOTS 1 2 AND LOT 3 BLK 1
to comprise a nuisance condition in violation of the Saint Paul Legislative Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On April 11, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Building Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is subject to the resh of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a two-story, wood frame, single family dwelling with a detached, one-stall, wood
frame gazage.
Exterior
1. Broken window in rear door.
2. The exterior walls of the house aze defective. Repair all holes, breaks, loose or rotting
siding, to a professional state of maintenance.
3. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
4. The window and(or door screens are missing, defective or in a state of disrepair.
Provide proper window and door screens for all openable windows and doors. Screens
must be tight-fitting and securely fastened to the frames.
5. The windows and/or storm windows are in a state of disrepair. Replace all missing or
broken window glass. Make a11 necessary repairs to fiames, sashes, hardware and
associated h in a professional manner. Permit may be required.
Interior
1. Smoke Detector: Lack of properly installed and operable smoke detector. Provide
functioning smoke detectors in accordance with the attached requirement, within 24
hours.
2. The interior walls are defective. Repair all wall defects and finish in a professional
manner.
3. The hear register is off the wall.
4. The water heater is damaged.
5. There is improper venting of gas fired appliances.
6. There is exposed wiring.
7. There is an open drain.

8. The kitchen flooring is damaged.
9. There is evidence of improper wiring.

10. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May Be
Required.
11. The stairs have missing or defective handrails. Provide all interior and exterior
stairways and steps of more fliat three (3) risers with handrails which are grippable and
installed 34" to 38" above the nose of the stair treads.
12. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.
13. The carpeting is in severe disrepair (heavily soiled by urine/feces).
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by May 24, 2007 Neighborhood Housing
and Property Improvement, Division of Code Enforcement, will begin a substantial
abatement process to demolish and remove the building(s). The costs of this action,
including administrative costs and demolition costs will be assessed against the property
tases as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey iu any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of auy new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Neighborhood Housing and Property Improvement. The department is further required to
file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify flze City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heazd from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.

If the resolution calls for abatement action the Councii may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

miniinum but not less than 5.7 sq. ft. overall).

7. Ordering the owner to remove or repair the building(s) at 1073 Eazl Street within fifteen (15)
days from adoption of resolution.
Kristine Speigelberg appeared on behalf of JP Morgan Chase Bank, along with Steven Shea, potential
buyer of the property.
Mr. Magner stated the building was a two-story, wood frame, single-family dwelling with a detached
single-stall gazage on a lot of 4,792 square feet and had been vacant since February 13, 2006. The
vacant building registrarion fees had been paid and the $5,000 performance bond had not been posted.
A code compliance inspection had been completed on Mazch 8, 2006. On April 11, 2007, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition was
developed. An order to abate a nuisance building was posted on Apri124, 2007 with a compliance date
of May 24, 2007. To date, the property remains in a condirion which comprised a nuisance as defined
by the Legislative Code. Ramsey County Tasation estimated the market value of the land to be
approximately $42,800 and the building to be $116,900. Real estate tases for 2006 had been paid.
Code Enforcement estimates the cost to repair the building to be approximately $20,000 to $40,000.
The cost for demolition was estimated to be approximately $10,000 to $12,000. There had also been
seven summary abatements issued to this property ten of which went to work order: to secure the
building and the City had to board the building to secure it from trespass, remove tall grass and weeds,
remove snow and ice from the sidewalk and to remove improperly stored refuse. Mr. Magner stated
that he had a conversation with Mr. Shea reguding his purchase of this property, that he should appear
at this hearing and that he be prepared to post the performance bond, have a signed purchase
agreement, and present a work plan and financial plan idenrifying his intention to rehabilitate the
property. Mr. Manger presented photographs of the property.
Ms. Moermond asked how long JP Morgan had been in possession of the property. Ms. Speigelberg
stated that the sheriffs sale occurred at the end of August, 2006 and she believed they took possession
in February, 2007 when the property became vacant. Ms. Moermond stated that accarding to Code
Enforcement, the building had been vacant since February, 2006.
Ms. Moerxnond asked Mr. Magner the history of the suminary abatements that had occurred at the
property since February, 2007. Mr. Magner stated that that there were work orders for snow removal
in January and in February and most recently, there was a work order to secure the garage. Ms.
Moermond asked whether there were any work orders to mow the lawn. Mr. Magner responded there
were none.
Mr. Shea asked whether any of the assessments were pending. Mr. Magner stated that the only
assessment that was pending was for the boarding and he could provide him with that cost.
Mr. Magner stated that since the code compliance had been done in March, 2006, it would need to be
reviewed by Mr. Seeger, Licensing, to determine whether it was in compliance to deternune whether
the conditions at the property had deteriorated since the last inspection.
Mr. Shea stated that he had signed a purchase ageement with the bank and the closing date was
scheduled for August 13 pending the recommendation at this hearing. He had obtained bids from tku�ee
licensed contractors; one for electric, one for plumbing and one for general rehabilitation. He stated
that he had a business relationship with each of these contractors who had worked with him in the past
on other projects. He also stated that he had financial statements demonstrating his ability to finance
the rehabilitation.

Ms. Moermond asked what the bids came in on the cost of the repairs. Mr. Shea stated that he had a
received a bid in the amount of $8,600 for the general building rehab; a bid for $8,900 for plumbing;
and a bid for $3,655 for the electria lt was his intention to also do some of the wark himself;
replacing carpeting, painting, etc. He aclaiowledged that the fumace needed to be tested to determine
whether it was still operable or needed to be replaced. He presented copies of the bids he had received,
his financial ability to do the rehabilitation and the work plan.
Ms Moermond asked Mr. Shea when he planned to post the $5,000 performance bond. Mr. Shea
stated that he would post the bond as soon as she made her recommendation.
Ms. Moermond asked Mr. Shea whether he had ever done rehabilitarions on other buildings. Mr. Shea
estimated that he had done approximately 50 different properties with code compliance inspections and
had worked with NIr. Seeger . Ms. Moermond stated that she would not recommend granting
additional time to do the rehabilitation to the property uniess the bond was posted.
Ms. Moermond stated that the following must be completed by Friday, July 27 at the end of the
business day: 1) the performance bond must be posted; 2) the vacant building registration form must
be filled out; 3) the vacant building fees must be paid; and 4) the property must be maintained. She
stated that she and Mr. Magner would review all of Mr. Shea's paperwork and if she had any questions,
she would contact him and if necessary, she would schedule another hearing for July 31. She would
then recommend the Council grant 180 days to repair the building.
