THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60
to 649 inclusive, of the Saint Paul Legislative Code,
pertaining to Use Districts, Height Districts; and
Rezoning of certain properties in the City of Saint Paul,
as amended, be and the same is hereby further amended so
as to rezone the following described property from "A"
Residence District to "C" Residence District, to -wit:

west 60 feet of the north 75 feet and
except the south 5 feet thereof; and the
north one -half of ' the east one -half of
Lot 19 except the north 75 feet and except
the south 5 feet ther6of, except portions
taken for roadway purposes, J. W. Bass
Garden Lots, according to the plat thereof
on=' file and of record in the office of the
Register of Deeds in and for�Ramsey County,
Minnesota, being located on the south side
of unimproved Clear Avenue between Westminster
Street, and the service road for T-1-H. 35E.
Section 2.-.This ordinance is hereby declared to
be an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 3. This ordinance shall take effect and
be in force upon its passage, approval and publication.

Dear Madam:
This is in the matter of the petition of Alfred N. and Lillian Sbeid to rezone
from "A'1 to "C" residence property located on the south side of unimproved Clear
Avenue between Westminster Street and the service road for R.H. 35E and described
as the north one -half of Lot 20 except the west 60 feet of the north 75 feet and
except the south 5 feet thereof; and the north one -half of the east one -half of
Lot 19 except the north 751feet and except the south 5 feet thereof, except por-
tions taken for roadway purposes, J. W. Bass Garden Lots.
On June 6, 1962, the Commissioner of Finance reported the petition sufficient
with the owners of 11 of a possible 16 (68.75%) tracts of land within the pre-
scribed 100 foot radius having signed the petition. The site is presently de-
veloped with a very old single - family residence, a barn and a garage, all of
which are in poor repair and which occupy a small portion of the site. The re-
maining part of the tract is vacant. If rezoned, it is proposed to develop the
site with one 23 unit and six 17 -unit apartment buildings (119 units) with off -
street parking accessory thereto. This is an irregularly shaped tract of land
having a frontage along the service road of T.H. 35 E of approximathly 362 feet,
a frontage on unimproved Clear Avenue of 237.-feet and 437 feet on the west side
of Westminster Street resulting in an area of approximately 171,625 square feet
or 3.94 acres.
Directly north and across unimproved Clear Avenue are vacant lots fronting on
both Clear Avenue and Westminster Street, farther to the north are two single -
family residences fronting on Cottage Street and two singlefamily residences
fronting on Westminster Street; east and across Westminster Street is a single -
family residence fronting on said street, also a large tract of land being used
for truck gardening purposes; southeasterly and across Westminster Street are
five single- family residences fronting on said street; directly south and adjoin-
ing is a large vacant,.tract of land fronting on the service road of T.H. #35E
also several substantial single - family residences fronting on Westminster Street;
west and adjoining is the rigbt -of -way of T.H. #35E. The proposal of 119 units
would provide 1,442 square feet of lot area per unit. The maximum allowable
building ground coverage is 60,070 square feet. The applicant proposes a build-
ing ground coverage of 35,024 square feet, or approximately 21% of the site area.
Therefore, the proposal meets the density requirements for multi - family residences
in the "C" residence district.
The Board of Zoning considered this matter at their regular meeting on June 21,
1962, and it is their opinion that the type of development proposed would be
very suitable for this large area which is adjacent to the freeway.
