1 WHEREAS, Chapter 293 of the Saint Paui I,egislative Code was enacted to regulate the subject of

WHEREAS, §293.11 provides for the granting of variances from the sound level 1'unitations
contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hazdskrip on the applicant, other persons or on the community; and
WHEREAS, St. Paul Saints Baseball Club represented by Tom Whaley, Executive Vice President,
who has been designated as the responsible person on the application, has applied for a variance to
present amplified music at Midway Stadium, 1771 Energy Park Drive and
WHEREAS, applicant is seeking a variance for the hours of 6:00 p.m. to 10:30 pm., on
September 1, 2007; and
WHEREAS, if applicant is not granted a variance it will not be able to present live music at
Midway Stadium, 1771 Energy Park Drive; and
WHEREAS, the Deparhnent of Safety & Inspections has reviewed the application and compared it
to other noise variances that were approved by the Council and has made recommendarions regarding
conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to the St. Paul
Saints Baseball Club, subject to the following conditions:
1) The variance shall be for the hours of 6:00 p.m. to 1030 p.m., on September 1, 2007, at
Midway Stadium, 1771 Energy Park Drive.
2) All electronically powered equipment used in conjunction with the event shall not exceed 100
dBA, as measured at the sound mix.
3) The applicant shall provide personnel and equipment that shall provide continuous sound level
monitoring between 6:00 p.m. and 10:30 pm. on September l, 2007 to ensure compliance with
Condition #2.

4) All electronically powered equipment, PA systems, loudspeakers or sunilar devices shall be
turned off no later than 1030 p.m. on September 1, 2007.
FURT`HER RESOLVED, that any violations of the conditions set forth above on the September 1,
2007, dates may result in denial of future requests for the grant of a noise variance, in addition to any
criminal citation which might issue.
