4 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations
$ contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
(> constitute an unreasonable hardship on the applicant, other persons or on the community; and

g WHEREAS, Skinner's Pub, represented by Peter Skinner, Owner, who has been designated as the
9 responsible person on the application, has applied for a variance to present amplified music at Skinner's

WHEREAS, applicant is seeking a variance for the hours of 12:00 (noon) to 10:00 p.m., on
August 11, 2007; and
WHEREAS, if applicant is not granted a variance it will not be able to present live music at
Skinner's Pub, 919 Randolph Avenue; and
WHEREAS, the Department of Safety & Inspections has reviewed the application and compared it
to other noise variances that were approved by the Council and has made recommendations regazding
conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Skinner's Pub,
subject to the following conditions:
1) The variance shall be for the hours of 12:00 (noon) to 10:00 p.m., on August 11, 2007, at
Skinner's Pub; 919 Randolph Avenue.
2) All electronically powered equipment used in conjunction with the event shall not exceed 90
dBA, as measured at the closer of the sound mix or 50 feet from the stage.
3) The applicant shall provide personnel and equipment that shall provide continuous sound level
monitoring between 12:00 (noon) and 10:00 p.m. on August 11, 2007 to ensure compliance
with Condition #2.

4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be
tumed off no later than 10:00 p.m. on August 1 l, 2007.
FURTF3ER RESOLVED, that any violafions of the condirions set forth above on the August 11,
2007, date may result in denial of future requests for the grant of a noise variance, in addition to any
criminal citation which might issue.
