RESOLVED, by the Council of the City of Saint Paul,
in the matter of condemning, taking and appropriating for
roadway purposes the following described property:
Lots seven-(7) and eight (8), Block two (2),
Riverside Addition No. 2, according to the plat
thereof on file and of record in the office of
the Register of Deeds in and for said Ramsey County,
Minnesota;
as duly ratified by the Council on April 11, 1962, by Resolution
known as Council File No. "2067+1, that the award of damages in
the sum of $12,500 for the taking of the aforesaid property shall
be and hereby,-Js increased so that the same shall be and represent
an award of damages in the amount of $14,000; be it
RESOLVED FURTHER, That the aforesaid increase in respect
to the award of damages shall be contingent upon the dismissal
of the pending purported appeal to the District Court of Ramsey
County, Minnesota, by Charles Spadino and Dorothy E. Spadino,
by the Order of said District Court to be made and filed therein
within twenty days next after the date hereof and is provided�to
be made hereunder pursuant to the recommendation and request of
the Department of Public Works of the City of Saint Paul and of
the City Valuation Engineer; be it
RESOLVED FURTHER, That the award of damages as so increased,
subject to the aforesaid contingencies, shall be payable from
City of Saint Paul PIR Fund L6170 -14, such charge to PIR Fund to
be reimbursed from Municipal State Aid, or such other funds as are
available at the time payment is made.
