2 WHEREAS, the Department of Public Works plans to reconsiruct streets within the White BeazBurns
3 project azea as part of the 2007 Residential Street Paving Program;
5 WHEREAS, the property located at 1689 Upper Afton Road is within said project azea and is proposed to
6 be assessed its share of the reconstruction of Flandrau Place, which abuts the property on the east; and
8 WHEREAS, consistent with city long side assessment policy, said property is to be assessed for the
9 reconstruction of 125.00 feet of Flandrau Place at a combined paving and lighting rate of $38.29, for a total
10 assessment of $4,786.25; and

]2 WHEREAS, Flandrau Place provides no practical benefit to the property because it is not used by the
] 3 property owner for physical access or for utility connections; now, therefore be it

15 RESOLVED, that the proposed RSVP assessment for the property located at 1689 Upper Afton Road be
16 ratified with other properties in the White BeazBurns project area, then immediately deferred for up to 20
17 years without accumulation of interest during the period of deferment, unless phvsical access or utilitv
I8 connections are nrovided from Flandrau Place, in which case the total deferred principal amount shall be
] 9 assessed in installments over the remainder of the 20-year assessment term with interest accruing only from
20 the date the deferment was canceled. In the event the property is sold within the 20-yeaz period of
21 deferment, the total assessment shall be cancelled against said property at 1689 Upper Afton Road; and be it

24 RESOLVED, that if after 20 years of ratification of the assessment no such access has been provided from
25 Flandrau Place, the total assessment shall be canceled against said property at 1689 Upper Afton Road.
