O'Connell City Clerk Building Dear Madam: This is in the matter of the petition of John S. Young to rezone from "B" to "C" residence property located on the north side of Maryland Avenue between Mackubin and Norton Streets extended and described as the east 7865 feet of the west 203.5 feet of the south 228.17 feet of Lot,39, Cottage Homes. On June 12, 1962, the Commissioner of Finance reported the petition sufficient with the owners of 5 of a possible 7 (71%) tracts of land within the prescribed 100 foot radius having signed the petition. The site is vacant and approxi- mately 10 feet below the grade of Maryland Avenue. The petitioner proposes to develop the site with a 12 unit apart- ment building. The lot has a frontage of 78.5 feet on Maryland Avenue and a depth of 198.05 feet resulting in an area of approximately 15,548 square feet. To the west and adjoining is a rental trailer business, which is operating under a five year permit granted in June of 1959, and two single- family residences; to the north and east is vacant land; to the north- east is a newly constructed roller skating rink; south and across Maryland Avenue are various type residential uses. Field investigation discloses that the area is not attractive for single or two - family residential development; a commercial use would be detrimental to the residential uses in the area; therefore, it appears that the highest and best use of the pro- perty is multi - family residential uses. In consideration of the above factors, the Board of Zoning recommends the granting of the petition to rezone the above described property from "B" to "C" residence district. HCW :FGI Encl. Z.
