AN ORDINANCE AMENDING SECTION 445.02 OF THE
LEGISLATIVE CODE OF THE CITY OF SAINT PAUL,
APPROVED MAY 105 1949, ENTITLED: "AN
ORDINANCE REGULATING AND CONTROLLING THE
EMISSION OF SMORR AND POLLUTION OF AIR
WITHIN THE CITY OF SAINT PAUL; PROVIDING
FOR THE APPOINTMENT OF AN ADVISORY BOARD;
PROVIDING PENALTIES FOR THE VIOLATION
THEREOF, AND REPEALING ORDINANCE NO. 5578,
APPROVED NOVEMBER 5, 19255 AND ALL OTHER
ORDINANCES OR PARTS OF ORDINANCE INCON-
SISTENT HEREWITH. "' THIS IS AN EMERGENCY
ORDINANCE RENDERED NECESSARY FOR THE PRESERVA-
TION OF THE PUBLIC PEACE, HEALTH AND SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
SECTION 1
That Section-445.02 of the Legislative Code of the
City of Saint Paul, approved May 10, 1949, hereby is amended
in the following particulars, to -wit:
That Section 2 of said ordinance reading as follows:

"The Commissioner of Public Utilities shall
appoint an Advisory Board of five (5) members, a
registered Mechanical Engineer with combustion ex-
perience, the Director of the Municipal Testing
Laboratories, one a railroad representative, one
an operating engineer, and one a representative

from the real estate board. Such Board shall be

known as the Advisory Board on Smoke Elimination
or Air Purification. The second member to serve

as a member as a part of his official duty with-
out extra pay. The other four members named shall
serve a term of two years and without pay. The
duties of said Board shall be to confer with and
advise the Commissioner of Public Utilities with
respect to the elimination of air.pollution and

enforcement of this ordinance. The minutes of the

office of the Commissioner of Public Utilities as
a public record ",

"The Commissioner of Public Utilit es shall
appoint an Advisory Board of six (6) m hers, a-
registered Mechanical Engineer with co bustion
experience, the Director of the Munic' al Testing
Laboratories, one a railroad represen ative, one
an operating engineer, one a represenn ative from
the real estate'board and one an emp ogee of the
Health Department. Such Board shall be known as
the Advisory Board on Smoke Eliminat on or Air
Purification. Employees of the Cit shall serve'
as members as a part of their offic al duties
without extra .pay and the other me ers shall serve
without pay., All members shall se ve a term of two
years.' The {duties of said Board s all be to confer
with and advise the Commissioner o Public Utili-
ties with respect to the eliminati n of air pollu-
tion and enforcement of this ordi nce. The
minutes of the. meeting of the Advisory Board shall

SECTION 2.
This ordinance is hereby dec ared to be an
emergency ordinance rendered necessary for the preservation
of the public peace, health and safety
SECTION 3.
This ordinance shall take ef�ect and be in force
upon its passage, approval and publica ion.
