WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two-story, wood frame duplex with a detached, oversized, one-stall, gazage
located on property hereinafter referred to as the "Subject Property" and commonly lrnown as
614 WELLS ST . This property is legally described as follows, to wit:

10 WHEREAS, based upon the records in the Ramsey County Recorder's Office and

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated Apri19, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the shucture located on the Subject Property by Apri125, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was heid before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, June 26, 2007 to heaz testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested
or responsible parties to make the Subject Property safe and not detrimental to the pubiic peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating

this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitarion or demolirion of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WI�EREAS, a hearing was held before the Saint Paul City Council on Wednesday, July
18, 2007 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 614 WELLS ST .
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 haue been fulfilled.

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicabie codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
fdteen (15) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Deparlment of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a two-story, wood frame, duplex with an oversized one-stall garage on a lot of
2,614 square feet.
According to our files, it has been a vacant building since February 2, 2005.
The current property owner is Robert and Karen Thao, per AMANDA and Ramsey county
property and taxation records.
The city has had to board this building to secure it from trespass.
There have been sixteen (16) SUNIMARY ABATEMENT NOTICES since 2005.
There have been seven (7) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
- Removal of snow and ice
- Secure the buiiding
On March 22, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A?�T[JISANCE BUILDING was posted on Apri19, 2007 with a compliance date of
Aprii 25, 2007. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $500.00.
Taxation has placed an estimated market value of $25,000 on the land and $75,000 on the
building.
As of May 18, 2005, a Code Compliance inspection has been completed.
As of June 25, 2007, the $5,000.00 performance bond not been posted.
Real Estate taxes for the year 2006 aze delinquent in the amount of $1292.11 plus penalty and
interest.
Code Enforcement Officers estimate the cost to repair this structure is $60,000 to $80,000. The
esrimated cost to Demolish is $8,000 to $10,000.

On March 22, 2007, a Building Deficiency Tnspection Report was compiled and tYie
following conditions were observed.
This list of deficiencies is not necessarily ail the deficiencies present at this time. As
first remediai action, a Code Compliance Inspection must be obtained from the
Suilding Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is subject to fhe restrictions of Saint Paul Ordinance Chapter 33.03 and
shall not a�ain be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is iwo-story, wood frame duplex with an oversized, single stall gara�e.
Interior
The bathroom floor cover is deteriorated or inadequate. Provide floor covering which
is impervious to water and easily cleanable throughout the bathroom and seal around
the edges and fixtures.
2. There is open electrical.
3. The furnace is disassembled.
4. The stairs have missing or defective handrails.
5. The interior ceilings are defective.
6. The interior walls are defective.
7. Lack or basic facilities. Gas service is shut off.
8. There is crowned venting on plumbing.
9. The windows and/or door screens are missing, defective or in a state of disrepair.
10. The windows and/or storm windows are in a state of disrepair. Replace ail missing or
broken window glass.
Exterior
11. The eaves and soffits are in a state of disrepaix or deterioration. Repair all defects,
holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit
may be required.
12. The exteriar walls and/or trim of the house and/or garage has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a
sound condition in a professional manner.
13. The exterior walls and/or trim of the garage has defective, peeled, flaked, scaled or
chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound

14. DEFECTIVE STAIRS: The stairs are broken, defective, or in disrepair.

As owner, agent or responsible party, you aze hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by Apri125, 2007 Neighborhood
Housin� and Property Improvement, Division of Code Enforcement will be�in a
substantial abatement process to demolish and remove the building(s). The costs of this
action, including administrative costs and demolition costs will be assessed against the
property tases as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Desi� Section, 8 Fourth Street, Suite �200, Commerce
Building, (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subj ect to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Neighborhood Housing and Property Improvement. The department is further required to
file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution ca11s for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if conective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

23. Repair walls and ceilings throughout, as necessary.
24. Tuck Point interior/exterior foundarion.
25. Repair sofFit, fascia trim, etc. as necessary.
26. Provide hand and guard rails all stairways and steps as per attachment.

floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all bedroom
windows shall meet emergency egress requirements (20" wide minimum, 24" high

4. Ordering the owner to remove or repair the building(s) at 614 Wells Street within fifteen (15)
days from adoption of resolurion.
Mr. Magner stated the buiiding was a two-story, wood frame, duplex with an oversized, one-stall
gazage on a lot of 2,614 squaze feet and had been vacant since February 2, 2005. A code compliance
inspection was conducted on May 18, 2005. The vacant building registration fees were delinquent in
the amount of $500 and the $5,000 performance bond had not been posted. . On March 22, 2007, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition was
developed. An order to abate a nuisance building was posted on Apri19, 2007 with a compliance date
of Apri125, 2007. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to
be approximately $25,000 and the building to be $75,000. Real estate tases for 2006 were delinquent
in the amount of $1,29211, plus penalty and interest. Code Enforcement estimates the cost to repair
the building to be approximately $60,000 to $80,000. The cost for demolition was estimated to be
approximately $8,000 to $10,000. There had also been 16 suminary abatements issued to this property
since 2005, seven of which went to work order: to secure the building and the City had to board the
building to secure it from trespass, remove improperly stared refuse, remove tall grass and weeds and
remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15
days. Mr. Magner presented photographs of the property.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that this
was a field find by himself.
The property owners of record, Robert and Karen Thao, did not appeaz.
Christina Weber, Wilfard & Geske, appeared on behalf of the mortgage company, GMAC. Ms. Weber
stated that GMAC did not contact their office until the previous evening and informed her that the
property was not in foreclosure yet as they were attempting to work with the owners to save the
mortgage. There was a breech letter that expired on July 4, 2007 which meant GMAC could not begin
foreclosure proceedings until after July 4 and it would be quite some time after that when GMAC
would be able to do anything on this property. She understood the City wanted the mortgage
companies to go into the properties to make repairs before they become the owners, however, for
various reasons, mortgage companies haue a lot off issues doing that since they do not own the
properties. GMAC needed time to determine what was going to happen with the property and if it did
go into foreclosure, they would need time before they could even take any action to shorten the
redemprion period.
Ms. Moermond asked when GMAC was notified that this was a vacant building. Mr. Magner stated
that the Thaos still owned the property and the notice was sent to them, however, the order to abate the
nuisance condition would have been sent to GMAC. The order to abate was mailed on Apri19, 2007.
He also recently found out that the property the Thaos list as their residence at 2195 Valley View Place
was vacated by them in October, 2006. According to one of the neighbors, several of the neighbors
had been trying to maintain the exterior of the property and had become tired of doing so. Apparently,
the Thaos allowed the house to freeze and in February when the whether warmed, the neighbors saw it
"rairung" out the back of the house. Code Enforcement had now opened a vacant buiiding file on this
property as well.

Ms. Moermond stated that since the property taxes were delinquent, it appeazed the property would go
tas forfeit and that GMAC would completely lose the property. Mr. Magner stated this property was
located in a targeted azea and with a vacant properiy, it would likely go tas forfeit within 18 months.
Ms. Moermond asked how many of the summary abatements had gone to work order since April, 2007
when GMAC was sent the order to abate. Mr. Magner stated that two of the suminary abatements
went to work orders and that Code Enforcement most recently mowed the lawn in June.
Ms. Weber stated that in her conversation with GMAC the previous evening, they indicated they had
now ordered the property to be maintained and secured.
Mr. Magner pointed out that the Code Compliance inspection had been done on May 18, 2005 for a
David Walker of Litton Loan Servicing. He believed the conditions at the property had likely
deteriorated since that time and that 7im Seeger, Licensing, would need to do a review of the
condirions at the property. In reviewing the report from 2005, there was an extensive list of repairs
that needed to be made at that time. He believed the outstanding balance on the mortgage was
approximately $85,000 plus the outstanding property tases, plus the cost of the repairs; it may be that
GMAC may not wish to save this property considering it was not the best asset to the neighborhood.
Ms. Moermond stated that since this was scheduled for public hearing on July 18, the property
definitely needed to be maintained, the vacant building registration form and fees would need to be
filled out and the fees paid, the bond would need to be posted, the real estate taxes would need to be
paid, the work plan and the financial plan would need to be received by noon on Monday, July 16. She
would also require that the code compliance inspection be reviewed by Mr. Seeger to determine the
current conditions of the property.
Ms. Moermond recommended laying this matter over to the July 17 Legislative Hearing.

Ms. Weber stated that GMAC had not met anything of the requirements as they were in the process of
breeching the mortgagor and then foreclosing on the property. It was her understanding that GMAC
trying to determine the best way to take this properiy; whether it was worth saving or whether it should
be demolished. They simply did not have enough time to make this determination and were requesting
addirional tune.
Ms. Moermond stated that they could have registered the building as a vacant building, paid the vacant
building registration fees, paying the bond as well as paying the past real estate taxes. Ms. Moermond
asked if GMAC had met any of those requuements.
Ms. Weber stated that if they were going to allow the building to be demolished, they had no interest in
paying the fees, the bond ar the taxes.
Ms. Moermond recommended the building be removed within 15 days with no option for repair unless
the conditions were met by noon on July 18.
