The rehabilitation or demolition of the shvcture to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, July 18, 2007 and the testimony and evidence including the action taken by the Legislafive Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 343 MAPLE ST. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of this building(s) is es6mated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. If the above corrective action is not completed within this period of rime Deparhnent of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Properiy pursuant to the provisions of Chapter 45 of the Saint Paul Legislarive Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any land which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. According to our files, it has been a vacant building since March 29, 2006. The current property owner is Countrywide Mortgage c/o Christine Kawohl Remax, per AMANDA and Ramsey county property and taxation records. The city has had to board this building to secure it from trespass. There have been six (6) SUMMARY ABATfiMENT NOTTCES since 2006. There have been five (5) WORK ORDERS issued for: - Removal of improperly stored refuse - Removal of tall grass and weeds - Secure the building On March 28, 2007, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. The dwelling has a severely deteriorated foundation, creating a dangerous condition. The foundation structure will need to be inspected by a structural engineer and the dangerous condition repaired under permit and signed off by the building department. 13. DEFECTNE STAIRS. Stairs are broken, defective, ar in disrepair. Repair in a professional manner. Interior 14. FURNACE: Have a licensed heating contractor service and clean the fumace or boiler and make any necessary repairs. Perform a C/O test on the heating plant. Repair all ceiling defects and finish in a professional manner. 16. The interior walls are defective. Repair all wa11 defects and finish in a professional manner. 17. Smoke Detector: Lack of properly installed and operable smoke detector. Provide functioning smoke detectors in accordance with the attached requirement, within 24 hours. General 18. Due to the number of deficiencies, a Code Compliance Inspection will be required before a Placard Lift will be issued. 19. The dwelling is in a dilapidated and deteriorated condition due to a lack of maintenance and repair over a number of years. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by May i l, 2007 Neighborhood Housing and Property Improvement, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taYes as a special assessment in accordance with law. If the resolution calls for abatement action the Council may either order the City to take the abatement acrion or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Le�islative Code and provide that if corrective action is not taken within the specified time, fhe City shall abate this nuisance. Ordering the owner to remove or repair the buiiding(s) at 343 Maole Street within fifteen (15) days from adoprion of resolution. Mr. Magner stated the building was a two-story, wood frame, single-family dwelling on a lot of 3,484 square feet and had been vacant since Mazch 29, 2006. A code compliance inspection had been done on May 10, 2007 and the vacant building registration fees had been paid. The $5,000 performance bond had not been posted. On March 28, 2007, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on April 11, 2007 with a compliance date of May 11, 2007. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimated the mazket value of the land to be approximately $39,900 and the building to be $87,000. Rea1 estate tasces were current. Code Enforcement estimates the cost to repair the building to be approximately $30,000 to $40,000. The cost for demolition was estimated to be approximately $9,000 to $10,000. There had also been six summary abatements issued to this property since 2006, five of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and remove tall grass and weeds. Mr. Magner stated that the building was located in the Dayton's Bluff Historic Preservation area and a Section 106 background check of the property found that it was not on the historical national registration list and it was not a significant or contributing property to the area. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked how Code Enforcement became aware this was a vacant building. Mr. Magner stated that it was discovered the building was vacant during a field find. Christina Weber, Wilford & Geske, appeared on behalf of the mortgage company, Countrywide Mortgage. Ms. Weber questioned the dates of the work orders as the broker for the property, Christine Kawohl of Remax, was actively marketing the property and she believed she was monitoring it very closely and would address any problems at the property. Mr. Magner stated that the last summary abatement was issued to Countrywide on May 31, 2007 to cut tall grass and weeds which went to work order. Ms. Weber asked whether Ms. Kawohl could be listed as the responsible party to receive orders from the City. Mr. Magner stated that according to their records, Ms. Kawohl was noted as being a responsible party for the property when the vacant build'mg registration form and fee was paid on June 15, 2007. Although the code compliance inspection report was done on May 10, 2007 and was sent to Mr. Kawohl at Remas, it would not trigger an ownership or a mailing request change. The only way contact information could be changed for a vacant building was when the vacant building registration form was completed. Ms. Weber stated that Counh•ywide was in the process of obtaining bids on the repairs to the building. She believed they had already obtained one bid, were in the process of obtaining a second bid and would then deternune the cost of the repairs. She believed the bid they did receive was higher than the estimated $30,000 to $40,000 cost indicated by Code Enforcement. Once the total amount of the bids was received, they would determine whether the property should be repaired. She believed that if Countrywide did determine this was a property they wished to save, they would then post the bond, create a work plan as well as a financial plan. Ms. Moermond stated that since this was scheduled for public hearing on July 18, she would need to have the bond posted, the work plan and the financial plan received by noon on Monday, July 16. She June 26, 2007 Legislative Aearing Minutes °���7 Page 5 would also require a signed purchase agreement if the property were soid to someone who was rehabilitating the building if Countrywide deternuned they did not want to make the repairs themselves. Ms. Moermond also stated that she did not believe Ms. Kawohl was proactively managing the property since the City had to mow the lawn. She would also require the property be maintained. (Laid over from June 26 L,egislative Hearing) Ms. Moermond stated that at the hearing on June 26, she requested that the bond be posted, a financial plan and a work plan outlining specified timelines needed to be received by noon on July 16. She had received the financial plan and the work plan via e-mail and had discussed with Ms. Weber the need to indicate some timelines on the work plan. Christina Weber, Wilford & Geske, stated that the bond had been posted. It was her information that Countrywide was working duectly with the contractor to obtain some specific timelines for work on the property. She did not have that information available and was not sure if she would be able to provide this prior to the public hearing on July 18. Ms. Moermond stated that if she did not have the work plan indicating the specifc timelines, she would request the matter be laid over in public hearing to August 1. Ms. Weber stated that she would contact Countrywide to see if they would be able to provide this information prior to the public hearing. Mr. Magner questioned when the bond had been posted. Ms. Weber stated that her records indicated that the bonding company had sent a courier on June 29 to Neighborhood Housing and Property Improvement at 1600 White Bear Avenue. Mr. Magner stated that Code Enforcement would not have accepted the bond as they do nof have the format to accept it and they would haue directed the courier to DSI-Licensing in the Commerce Building. Ms. Moermond stated that the bond would need to be posted prior to the public hearing on July 18 by 430 p.m. in arder for her to request the City Council to lay this matter over to August 1. She would then recommend Countrywide be granted 180 days to complete the repairs. If the bond was not posted prior to the public hearing on July 18, she would recommend to the City Council that the building be removed within 15 days.
