RESOLVED] In the matter of the condemning and taking
of certain lands by the City of Saint Paul, for flood control
purposes ratified and confirmed together with the Awards of
Damages therefor by the prior Resolution of this Council,
C. F. No. 201806, approved April 26, 1961, that the therein
purported Appeal to the. District Court by Northern Valley
Company from the Award of Damages so ratified and confirmed for
said City's condemnation and taking of the following described
lands situate within the corporate limits of saidXity:

Lots 2 through 11, Block 4, Lots 1 through 22,
Block 3, and Lots 9, 10 and 11, Block 2, Second
Addition to Brooklynd, St." Paul, Minn. also all
public streets, alleys and ways necessary for
flood control purposes and contiguous to the
hereinabove described lands and upon which
said hereinabove described lands or any of the
same abut, heretofore or hereafter vacated,
together with all lands and interests in lands
which embrace every such,.t,-ontiguous public street,
alley and way;
a
which Appeal presents questions of fact and law and said
Appellant's claim for an aggregate Award of Damages in the
amount of $75,000, as distinguished from the aggregate Award
of Damages so ratified and confirmed for said condemnation
and taking of said hereinabove described lands in the amount
of J17,500, be fully and forever compromised and settled to-
gether with all controversies thereby involved, pursuant to
the recommendation of said City's Valuation Engineer after
reappraisal of said hereinabove described lands, by the in-
crease in said aggregate Award of Damages to the amount of
$24,000, apdthe Corporation Counsel having concurred in said
recommendation for such disposition of said matter; that ac-
cordingly said prior Resolution and the pertinent Assessment
Roll shall be deemed hereby amended so as to substitute said
aggregate- -Award of Damages of $24,000 for said prior Award
of X7,500, on account of the subject condemnation and taking,

the same shall be subject to the proviso that said purported
Appeal shall be dismissed with prejudice and that said Ap-
pellant shall by Warranty Deed convey or cause to be conveyed
unto said City all of the hereinabove described lands;
RESOLVED FURTHER, That the Port Authority of the
City,of Saint Paul, by its letter dated December 17,j19620
herewith filed has cota.curred in the aforesaid recommendation
by said Valuation Engineer therefor and such disposition of
said purported Appeal and all said controversies thereby pre-
sented and subsisting between said City and said Appellant,
is deemed consistent with equity and justice and conducive
to the promotion of the,best interests of the City of Saint
Paul.
