THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Z oning Code, Chapters 60
to 64, inclusive, of the Saint Paul Legislative Code, pertain-
ing to Use Districts, Height Districts, and Rezoning of cer-
tain properties in the City of Saint Paul, as amended, be and
the same is hereby further amended so as to rezone the follow-
ing described property from "B" Residence District to "C"
Residence District, to -wit:
Lots 11, 129 139 149 15, and except the east
20 feet, Lot 10, Block 2, Schurmeier and Evans
Addition to St. Paul, according to the plat
thereof on file and of record in the office
of the Register of Deeds in and for Ramsey
County, Minnesota, -

subject to the following conditions:
That, in the event the hereinabove described
real estate, in whole or in part, shall be
taken and condemned for public highway pur-
poses by the City of Saint Paul, the County
of Ramsey, the State of Minnesota or the
United States of America within the period
of fifteen (15) years next succeeding the
effective date of this Ordinance,the compensa-
tion required to be paid or secured by the
condemnor on such account shall not include
any consideration of value of said real estate
or involve any item of damages solely attri-
butable to the aforesaid rezoning of said real
estate hereunder or to any future improvement
of the same dependent for its validity upon
such rezoning and the owners of said real estate
within 30 days next after the effective date
of this Ordinance file ih two counterparts with
the City_Clerk their written covenant approved
by the Corporation Counsel in recordable form
running with the land and accordingly delimiting

The "City Council requested that you prepare an ordinance granting the
attached petition to rezone to Class "C" Residence District Lots 11,
12, 13, 14, 15 and except the east 20 feet, Lot 10, Block 2, Schurmeier
& Evans Addition, also described as 680 Greenbrier St., subject to the
recommendation of W. George M. Shepard, Street-and Highway Engineering
Coordinator, that an agreement be reached whereby the cost of acquisition
of this property would not be increased bedause of this rezoning.
The Council recommended that you talk to Mr. Shepard and Mr. Alfred H.
Schroeder regarding the details of W. Shepard's recommendation, as
set out in the letter of the Zoning Board hereto attached.

cient with,the. owners of 10 of .a possible 12 .(83 1/3%) tracts. of land witbin
the prescribed 100 foot radius .having signed the petition. 'rhe property is
developed'with -a large residence which. is used as a, boarding house for ha,ndi-
.capped people. The pvrpose:of tb.e. rezoning is,to legalize the present use.
Alterations will also have to be xade in the building to .meet the standard's.
of the Housing Code. 'The ,property ha's a frontage :of 220 feet on Beech Street
and 110 feet .on. Greenbrier Street, resulting in, =an area of 24,200 .square feet.
