THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to`
64, inclusive, of the Saint Paul Legislative Code, pertain-
ing to Use Districts, Height Districts, and Rezoning of
certain properties in the City of Saint Paul, as amended,
be and the same is hereby further amended so as to rezone
the following describedproperty from "B" Residence District
to "C" Residence District, to -wit:

plat thereof on file and of record in
the office of the Register of Deeds in

That; in the event the hereinabove de-
scribed real estate, in whole or in part,
shall be taken and condemned under the exer-
cise of the power of eminent domain, for
public highway purposes, by the City of
Saint Paul, the County of Ramsey, the State
of Minnesota or the United States of America,
within the period of fifteen (15) years next
succeeding the effective date of this ordi-
nance, the compensation required to be paid
or secured, by the condemnor, on such account,
shall not include any consideration of value
of said real estate or involve any item of
damages solely attributable to the aforesaid
rezoning of the same, hereunder or any future
improvement of the same dependent for its
validity upon such rezoning and the owners of
said real estate, within 30 days next after

On October 31, 1962, the Commissioner of Finance reported the petition suffi-
'cient with the owner, of 14 of a_ possible 16 .(87W tracts of .land within.
the prescribed 100 foot area having signed the petition. The property is
developed with a large residence Which is used,as a,,boar.ding house for handi-
capped people. T, purpose of the. rezoning i-s to Ise a.lize the present use.

Therefore, the Board.of Zoning recommends the granting of the petition to
rezone the above described - property to.a "C" residence district.
