W EREAS, Pizza Luce V Inc., d/b/a Pizza Luce, located at 1183 Selby Avenue in Saint
Paul, has req ested a waiver of the 45-day notice requirement for issuance of a 2 a.m. license
which will allo service of wine and strong beer until2 a.m.; and
WHEREA , the Lexington-Hamline Community Council has agreed to the waiver of the
notice requirements; d
WHEREAS, the C cil finds that the application is in order and there are no grounds
far denial of the license and t t failure to grant the waiver and the consequent delay in
approving the license would ca e excep �onal and unusual hardship to the license applicant; and
WHEREAS, the licensee a es that in the event a complaint is received prior to the
expiration of the 45-day period and complaint provides a basis for adverse action against the
license, that the Office of License, Insp tions and Environmental Protection may direct the
licensee to nnmediately discontinue all op ations until a public hearing is scheduled, and that
the licensee shall comply with said directive, now, therefore, be it
RESOLVED, that the 45 day notice requi ments of §409.06 of the Saint Paul
Legislative Code are hereby waived and a 2 a.m. li nse which will allow service of wine and
strong beer until 2 am. is issued to Pizza Luce V Inc., d/b/a Pizza Luce, located at 1183 Selby
Avenue in Saint Paul, subject to the agreement stated a ve.

The Lexington-Hatzzline Coznznunity Conncil supports action by the City Council to alter
the applicable licenses of Pizza Luce (a business operating at J, J,83 Se1by A.ve.) to permit
a 2 a.m, closing t�me and beex 2�d wine sale.
VVe also support waiving the 45-day public notice requixement 3n extending the closing
time from 1 a.m. to 2 a.xry so that Pizza Luce can begin operating immediately under the
new closing time.
