The number of vehicles displayed "for sale" outdoors (by Majesty Auto Sales) shall not exceed fourteen (14). The required spaces for customers and employees is three (3). All display vehicles and customer/employee vehicles on the site must be parked as shown on the approved site plan on file in LIEP, dated 3/30/07. (Any changes to the site plan must be approved by the Zoning Administrator). 2. The required pazking spaces for the auto repair facility (Holmgren Auto Works) for employees and customers are seven (7). There are seven (7) spaces marked for customer and employee use in the S W corner of the parking lot; all vehicles on the site must be parked as shown on the approved site plan on file in LIEP, dated 3/30/07. (Any changes to the site plan must be approved by the Zoning Administrator). 3. Customer, employee, or sale vehicles shall not be parked or stored on the street or alley. This includes cars which have been repaired and are awaiting pickup by their owners. All display vehicles on the site must be parked as shown on the approved site plan on file in LIEP, dated 3/30/07. (Any changes to the site plan must be approved by the Zoning Administrator.) 4. There shall be no exterior storage of vehicle parts, tires, oil, or any other similar materials associated with the business. Trash will be stored in a covered dumpster. 5. The license holder agrees to maintain the landscaping, vehicle location, and vehicle barriers in a manner consistent with the approved site plan. 6. All vehicles parked outdoors must appeaz to be completely assembled with no major body parts missing. 7. Vehicle salvage is not permitted. 8. Auto body and painting are not permitted. 9. No auto repair of vehicles may occur on the exteriar of the lot or in the public right-of-way. All repair work must occur within an enclosed building. 10. Customer vehicles may not be parked longer than 10 days on the premises. It shall be the responsibility of the licensee to ensure than any vehicle not claimed by its owner is removed from the lot as permitted by law. ll. Provide maneuvering space on the property to allow vehicles entering and exiting the site to proceed forward as stipulated on the approved site plan. 12. Licensee must comply with all federal, state, and local laws. 13. Storage of vehicle fluids, batteries, etc. shall be in accordance with Ramsey County Hazardous Waste Regulations. THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned conditions. Marcia Moermond explained that this is a Legislative Hearing. The applicant has applied for a Class N license, which means there is neighborhood notification. Someone has objected to this license. This is not a judgment that the objection is valid; rather, it automatically triggers this Legislative Hearing. Ms. Moermond is holding this hearing to come up with a recommendation for the City Council about the licenses. She can recommend one of the following to the City Council: 1) issue the license with no conditions, 2) issue the license with conditions that are agreed upon by the applicant, or 3) not approve the license and start the move to deny. Reid Soley reported that this is an application for Holmgren Auto Works LLC, doing business as Holmgren Auto Works. The applicant is applying for an Auto Repair Garage License at 1328 Point Douglas Road South. There are 13 license conditions that are being recommended. An affidavit agreeing to these conditions have been signed by the applicant. Ms. Moermond asked are these standard conditions. Mr. Soley responded many are standard and some of them had been applied in particular. Because Holmgren is going to be operated on the premises of Majesty Auto Sales, an existing business, the same license conditions are on both licenses. Mr. Soley has signed affidavits from both owners. The neighborhood organization has not weighed in on this matter. There is no need for an Environmental Health approval for this license application. The original fire inspection was for approval, but the fire inspector did not check to see if the water was working accurately on the premises. He has explained that it is so unusual for a property not to have a connected water source, he made an assumption, which he said he will not make in the future. He will also make sure there is hot water, whicb is required. Mr. Holmgren stated the property was grandfathered in. He had a hot water tank there, so the water was checked in the past. Since then, it has not been checked. When the new owner came in, the pipes were dug up, and that's when it got shut off. There was construction in front and the roads were ripped up for installing City sewer and water because there was just well down there. It came to his attention through a neighbor who called and said that he was supplying water to Majesty Water Sales for them to flush their toilets. Mr. Soley called David Bergman, Fire Inspector, who looked at the property and issued orders giving the property owner until August I. Ms. Moermond asked who is the property owner. Mr. Gott responded he is. He has owned the property for about 13 yeazs. The previous owner owned the two homes, the property, and the gas station there. He sold the commercial part to Mr. Gott on the contingency that it would be grandfathered in through the well. Mr. Gott was paying him more money to keep it operational. At some point, he was going to put City sewer and water in. When the previous owner was ripping out trees, he pulled out some of the pipes. They finally got the road construction done. They do have it stubbed into the property on the frontage right now. It is available, and they aze getting appraisals. Ms. Moermond stated that the last they heard was that Fire is issuing orders. Mr. Soley responded they were issued orders on May 30, 2007, to restore required water service to the building including hot water to the wash sink. An inspection was made to the building in response to a referral. It must be corrected immediately and a reinspection will be on or after August 1, 2007. Failure to comply may result in a criminal citation and revocation of the Certificate of Occupancy. The Saint Paul Legislative Code requires that no building shall be occupied without a Certificate of Occupancy. This was addressed to Gregory Gott, the property owner, and it was signed by David Bergman. Ms. Moermond stated this is an additional auto business in the same parcel. Mr. Holmgren responded, "Correct." Ms. Moermond asked was Majesty Auto closed down because of the water. Mr. Soley stated that he was not able until this moming to talk to Mr. Bergman and get the whole picture. There are no orders to shut down the premises at this time. With regard to this particulaz application for Holmgren Auto Works to obtain an Auto Repair Garage license, DSI is recommending thaY the application be kept at a pending status until the water and sewer are restored. Ms. Moermond recommends that the City Council approve the license application with the conditions that the applicant has already agreed to; however, the approval is contingent on the water being restored and the hot water being confirmed.
