RESOLVED, upon the recommendation of the
Commissioner of Public Works, that Council File No. 208135,
approved July 17, 1962, and relating to the condemnations
of easements in certain lands necessary for slopes, cuts and
fills necessary in the construction, grading and surfacing
of a certain alley in Block 3, Governor Johnson's Addition,
from Frank Street to the North and South alley and the North
and South alley from Jenks Avenue to Lawson Avenue, be and
the same hereby is amended in the following particulars; that
the lands and easements orde�o be taken, appropriated and
condemned for the purpose of king the improvements called
for under the resolution, be amended so that the same are
described as follows:
"For the slopes, cuts and fills, including the
right of removal of lateral support from subject
land or remainder thereof, occasioned by ex-
cavations thereof or construction of slopes in
the grading and surfacingTAith bituminous material
in Block 3, Governor Johnson's Addition, the North
and South alley from Jenks Avenue to Lawson Avenue
to the proposed change of grade to the extent shown
on the plan on file in the office of the Commissioner
of Public Works ";
and be it
FURTHER RESOLVED, That „the City Clerk is directed to
attach a copy of this resolution to Council File No. 208135, and
to insert in lieu of the description contained in the second to
last paragraph of the aforementioned resolution the description
contained in the body of this resolution, it being the true intent
and purpose of the prior resolution to describe the lands as the
same are herein described,; be it
FURTHER RESOLVED, That Council File No. 208798, adopted
and approved August 24, 1962, and purporting to amend Council
File No. 208135, may be and hereby is rescinded in its, entirety.
