Gentlemen:
Both Mr. Avery and myself will not be at the Council session
on Tuesday, October 2nd, when the matter of the improvement of Cliff
Street from Smith Avenue to St. Clair Avenue, and St. Clair Avenue from
Cliff Street to West Seventh Street, comes before the Council, this
including grading, paving and curbing the roadbed and street, alley
and driveway returns; grading and sodding boulevard areas; reconstruct-
ing existing paving, curbing, sidewalks and traffic control systems
where necessary; constructing a storm water drainage facilities; con-
structing sewer, water and gas service connections where necessary, and
doing all other work necessary and incidental to complete said improvement.
This improvement is made primarily for traffic, and traffic
only, and when this Order was first introduced in the Council, it was
my honest opinion that there should be no assessment against the
property owners abutting this improvement, as it will in no way improve
their property other than to create a traffic condition that they are
free from at the present time. However, the improvement is essential,
and I think that the entire cost should be borne by the City of Saint
Paul.

The hearing on the final order for the above described project is
scheduled for Tuesday, October 2, 1962. The actual paving of the
above mentioned streets is the final step in this project. The
necessary right -of -Nay has been acquired by the City at a cost of
$59,354.00 having been acquired by the process of eminent domain.
There appears to be a difference of opinion as to whether the abut-
ting properties will receive any benefits from this improvement and
whether the City should levy an assessment for the same.
The total amount that is proposed to be assessed, including new
sidewalks, is $13,268.00 ov 7% of the total estimated cost of the
improvement. The estimated cost of a 12 foot strip of paving is
$10.26. However, considering the properties to be assessed, the
estimated residential assessment rate for paving has been estimated
at $2.00 per lineal foot. The estimated cost of new curbing is $2.10
per foot; and the proposed assessment rate for curbing is $1.25 per
lineal foot; whereas in some areas the full cost of new curbing is
assessed and runs around $3.00 per foot. It is recommended to assess
the full estimated cost of the sidewalk except where good and suf-
ficient sidewalk now exists. This amounts to $0.50 per square foot.
The City Council may approve or change the amount that is recommended
by the Commissioner of Finance to be assessed against abutting property
owners for public improvements. Insofar as this improvement has not
been completed, and any forecast of benefits to the properties can
only be estimated, I recommend that any change in the assignment of a
value to the benefits for this improvement be deferred until the
report of the Commissioner of Finance to the Council, in the form of
the completed assessment roll, has been compiled and submitted pur-
suant to Section 244 of the charter.

could set a precedent and possibly affect the assessment of bene-
fits for future like improvements.

Re: Advisability of paving St.. Clair Avenue from West 7th Street
to Cliff Street and Cliff Street from St. Clair Avenue to Smith Avenue.
REASON FOR DELAY IN OBJECTING:
The property owners whom I represent on St. Clair were never notified of the proposed
improvement when it was commenced on Cliff Street. The Cliff Street improvement
f rom Smith Avenue to St. Clair was a separate proceedings authorized under the Bond
Issue and the property owners on St. Clair were notified only when their section was
to be condemned. In other words,. the Council had already given authorization to proceed
with demolition along Cliff Street, but the property owners along St. Clair were not
aware of this, nor the final effect upon them and, therefore, had no notice nor opportunity
to present the matter sooner.
Also, at the first hearing, they were assured by members of the Council that there
would be no assessments. However, they received their notices of assessments and
it was contra to some promises that were made at the Council session. I was not
present at that time and, therefore, I cannot elucidate further on this.
PROPOSED FEASIBILITY:
No one doubts the engineering feasibility of the plan to run traffic from the high bridge
along Cliff and down St. Clair. Hwvever, in view of projections for the heavy high
bridge traffic, proposed interchange at the foot of the bridge and diversion of the flow
of traffic., it would appear that there may be alternate solutions which will prove more
beneficial to traffic movement than the one presented here. The sharp angle off of the
bridge, the sharp angle off Cliff to St. Clair, the narrowness of St. Clair Avenue, the
bottleneck between Kessler & Maguire Funeral Home and the apartments - -all of these
impediments would appear to present only short -term solutions to this problem at a
rather high cost. Goodhue Avenue (which now takes a tremendous amount of traffic)
and Michigan Avenue are both wider streets and present better accessjto West 7th Street.
However, if St. Clair is to be used, it would appear that all of the houses should be
removed from the south side of St. Clair so as to build a wider road and set up a crossing
at St. Clair and West 7th Street that would be able to take care of the flow of traffic.
At least this would have the effect of providing a roadway proper in width and for proper
movement of traffic and would at least pr9tect the yaJ es Qf. the homes on one side of the
street.

PRESENT CONSTRUCTION PLANTS FOR ST. CLAIR:
The houses presently located on this street are of old construction, built close to the
front property line and are occupied by a large percentage of widows, retired employees
and older people. The City plans to take over the whole of the boulevard and at least
two to two and one -half feet of the present sidewalk for the roadway which will necessitate
the new sidewalk to be placed partially upon the present frontage of the property owners
and be of a narrower width (five feet).. This will have the effect,. in many instances,
of the street being ,located within six feet of the actual road. The awards for the property
taken have been niggardly, ranging from $12. 50 to $50.00.
ARE THERE ANY BENEFITS FROM THIS IMPROVEMENT?
The Engineer's Office and the Public Works Department have determined that this is a
facility for the general improvement .of the traffic and is.- of benefit to the City of St. Paul,
exclusively, and the costs should not be borne by the abutting property owners. The cost
under the proposed assessment would average close to $400' to $450 per home. This
would be an unwarranted assessment.. -not only because it's benefit is only to the traveling
public but also since the full cost is eligible and can be paid from monies .through the
Municipal State Aid Road Fund.
THE AREA WILL SUFFER AND NOT BENEFIT FROM THE IMPROVEMENT:
St. Clair Avenue is now a dead = end street. It is a neighborhood street with only its
residents using the facilities of said street. • It will be made a thoroughfare for vehicular
travel which -will benefit the City but not the property owners. Its proximity to the homes
after construction of the street (swallowing the boulevards and portions of the sidewalks) -
will be such to create a nuisance of noise, fumes and an. extreme danger to all residents.
It will destroy the evergreens and trees that are now present along this street. It will
mean that snowplows will throw the snow directly upon the narrowed sidewalk (since there" '
will be no boulevards),,, which will create additional hazards and severe problems of slush:
and drainage.
It will present problems in parking,, in driveways, particularly if the contemplated plans
are followed through that sidewalks, in some instances, may be raised above their
present level. It will depreciate the property since the roadway will run so close to the
homes themselves.
For the reasons outlined above,. I think it can be readily ascertained that there can
hardly be any benefit to these property owners but rather, it will severely depreciate
their property for, resale value and will present problems of nuisance and danger that
were not present prior to the improvement. I

I respectfully suggest that these homeowners should not be penalized for the creation
., .�. of a. municipal arterial speedway. Their losses.which will be sustained,, as outlined
"'above' cannot be measured in dollars and cents,, but it certainly would be unfair to
further compound this loss by assessing them for devaluating their property.

The hearing on the final order for the above described project is
scheduled for- Tuesday, October 2, 1962. The actual paving of the
above mentioned streets is the final step in this project. The
necessary right -of -way has been acquired by the City at a cost of
$59,354.00 having been acquired by the process of eminent domain.
There appears to be a difference of opinion as to whether the abut-
ting properties will receive any benefits from this improvement and
whether the City should levy an assessment for the same.
The total amount that is proposed to be assessed, including new
sidewalks, is $13,268.00 or 7% of the total estimated cost of the ,
improvement. The estimated cost of a 12 foot strip of paving is
$10.26. However, considering the properties to be assessed, the
estimated residential assessment rate for paving has been estimated
at $2.00 per lineal foot. The estimated cost of new curbing is $2.10
per foot; and the
p proposed assesaenent rate for curbing is $1.25 per
lineal foot; whereas in some areas the full cost of new curbing is
assessed and runs around $3.00 per foot. It is recommended to assess
the full estimated cost of the sidewalk except where good and suf-
ficient sidewalk now exists. This amounts to $0.50 per square foot.
The City Council may approve or change the amount that is recommended
by the Commissioner of Finance to be assessed against abutting property a
owners for public improvements. Insofar as this improvement has not
been completed, and any forecast of benefits to the properties can I
only be estimated, I recommend that any change in the assignment of a
value to the benefits for this lisiprovement be deferred until the
report of the Commissioner of Finance to_the Council, in the form of

the completed assessment roll, has been coiled and - subrmitted �pur,-
suant to Section 244 of the:-charter.

The present method of assessing benefits for public improvements
has been successfully operative since the adoption of the city
charter in 1914. To deviate from this process in any one case
could set a precedent and possibly affect the assessment of bene-
fits for future like improvements.
I, therefore, suggest the City Council make a visual inspection of
the proposed construction limits before the start of construction
and again at the time the completed assessment roll is presented
for approval; and at that time, either approve the assessment rate,
or make any justifiable reduction thereto that might be necessary.
