having heard all persons,'objections and recommendations relative thereto, and having fully considered
the same; therefore, be it
RESOLVED, By the Council of the City of St. Paul that the precise nature, extent and kind of im-
provement to be made by the said City is. to improve MONTREAL AVENUE from St. Paul Avenue to
Fairview Avenue Iby widening the roadbeds, by resurfacing the present pavement; by
constructing curbs, by reconstructing the intersecting alley and street returns
where necessary by reconstructing sidewalks where necessary; by constructing storm
water drainage facilities; by constructing sewer, water and gas service connections
where necessary* and by doing all other work which is necessary and incidental to
complete said - improvement
and the Council hereby orders said improvement to be made.
RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and
directed to prepare plans and specificat' for said improvement, and submit same to the Council for

Returned herewith is the petition of

Due to its form and execution I do not
lieve that this petition qualifies as a Petition of Re-
nstrance. Sixty -three parcels of land abut the proposed
provement, of which seven parcels, or 11 %, have properly
gned as opposing the street widening. A total of 116
hers are involved, and fifty -one owners, representing 44%,
ve signed the petition. The petitioners further indicate
.at they have no objection to the resurfacing of this street
.t that they are concerned with the widening of the roadway.

petition as reflecting the feelings of the property

espity recommended by the Department of Public Works, The roadway
presently consists of two, 20 foot one ,vray roads, separated by a land-

Considerable difficulty was experienced during W winter's heavy snawa
in keepin- open an ad equate roadway past parked cars and the extra two
feet 4x3.11 help considerably. The Department of Public Utilities reports
that base had to be detoured last winter because of the difficulty of
passing twEen parked cars and snow windrerus. From Howell. to St. Paul
Avenue si etiralk under a recent Final Order is to be installed and con•
sequently the curb and gutter work can readily be phased in with the
sidewalk and driveway work on the boulevards. The 5 foot sidewalk„ in
order to ziinimize yard and slope interferences is tentatively proposed
for an offset of 3 feet from the property line. The remaining b6ulevard
from sidevalk to curb would then be 8 feet, which is adequate for trees
pedestrimtsafetyp and considerable snow storage. No assessment would
be levied for the curb setback which would be paid for from Nunicipal
State Aid
It i believed that all things considered, the community and the
neighborhood would best be served by the plan as proposed and approval
of the or er is recommended. An adequate roadway surface would be pro -
sided, am, the appearance of the area would be enhanced. The general
character of the neighborhood would be the same. The 24 inch curb set-
back woule, not be sufficient for any particular effect on the volume or
character of traffic vhich would continue to be moderate volumes of
passenger cars and occasional. busmg. The proposal would provide better
clearance from parked tehicles, better visCv3.].ity,,and be safer and nore
convenien particularly in the winter. With respect to pedestrians
crossings the 24 inch curb sets -back is not expected to have any ap-
preciable effect. Care must be exercised by both drivers and pedestrians
on any st eet in the city.
