The purpose of tlris agreement is to implement the pilot project ritled "Saint Paul Liegional Water Services Water Technician Job
Family Competency Team Recommendarions Report - November 20, 2006" aka the Competency Modeling Document and the "City
of Saint Paul - Water Technician Job Family Competency Matrix."
The City and AFSCME agree that the pilot project shall apply to those employees of Saint Paul Regional Water Services who hald
posirions allocated to the Water Utility Technician I, II, and III ciasses and who are represented by AFSCME.
Advantages If Approved:
Saint Paul Regional Water Services and the AFSCME-represented employees at Saint Paul Regional Water Services will both realize
benefits evolving from the modification of the Civil Service Rules noted in the attached MQA.
Disadvantages If Approved:
None.
DisadvanWges If Not Approved:
The new system of hiring, devised as part of the pilot project, will not be imptemented.

2007 Memorandum of Agreement
In accordance with Civil Service Rule 8.A.6, governing the impiementation of Human Resources
pilot projects, the City of Saint Paul (City) and the American Federation of State, Counry, and
Municipal Employees (AFSCME) have met and discussed the proposed pilot project. 'I'he
proposed pilot project is described in the attached documents titled "Saint Paul Regional Water
Services Water Technician 7ob Family Competency Team Recommendations Report—
November 20, 2006" aka the Competency Modeling Document and the "Ciry of Saint Paul -
Water Technician Job Family Competency Matrix — May 8, 2007." The City and AFSCME
agree that the pilot project shall apply to those employees af Saint Paul Regional Water Services
who hold positions allocated to the Water Utility Technician I, II, and III classifications. The
City and AFSCME agree that the following Civil Service Rules, as modified, shall be used in the
admuustration of this pilot pro,}ect:
Civil Service Rule 6.B (Examination Contents). Modify Civil Service Rule 6.B to
ailow qualifying exanunations, e.g., pass/fail for promotion candidates. This rule, as
modified, shall be used only for examivations used to detemune eligible candidates for
vacancies in positions allocated to the Water Utility Technician I, II, and III
classifications at Saint Paul Regional Water Services.
2. Civii 5ervice Rule 7(Eligible Lists). Modify Civil Service Rule 7 to allow for
promorion eligible lists established for positions aliocated to the Water Utility
Technician I, II, III classifications at Saint Paul Regional Water Services to remain in
effect indefinitely.
Civil Service Rule 14 (Promotion Requirements). This Rule goveming requirements to
be met for promotional rights still applies in full.
It is agreed that adoption of the ° City of 5aint Paui - Water Technician 7ob Family Competency
Matrix — May 8, 200T' shall be done through the twenty-day notice process.
It is further agreed that grievances arising from terms and conditions of employment in the City
of Saint Paul Civil Service Rules and Salary Plan and Rates of Compensation shall continue to
be processed through the procedure outlined in the current collective bargaining agreement
between the City and AFSCME. Any grievances arising from alleged violafions of the
procedures established in said pilot project shall be subject to the Civil Service grievance
procedure. However, because both parties aclaiowledge that the City retains its inherent
managerial rights to evaluate and select staff, any concerns regarding the substantive
deternunations of the Competency Review Panel shall be appealed to the Civii Service
Commission as outlined in the November 20, 2006 Competency Modeling Document, which is
attached.

2007 Memorandum of Agreement
It is further agreed that this Memorandum of Agreement shall run concurrently with the current
AFSCME collective bazgaining agreement once adopted by the Saint Paul City Council as a pilot
project. Automatic extensions of the Memorandum of Agreement shall occut unless either of the
parties, the City or AFSCME, decide to end or modify said agreement prior to the expiration of the
collective bazgauring agreement. It is further agreed that this Memorandum of Agreement shall not
be used to set, in any way, a binding precedent on either of the parties.
Finally, it is agreed that 60-calendaz days prior to the collective bazgaining agreement ending, the
City will nofify the American Federation of State, County, and Municipal Employees, in writing, that
said date is pending so that a discussion of the pilot process and the fixrther extension of the pilot can
be held.
