No.•of C/L of Fuller to University, Ashbach Construction Company,, Contractor, the specified date of completion is November 1, 1961, and WHEREAS, the Contractor has prosecuted the work diligently but due to Seal Coat work being deferred until 1962 be- cause of unfavorable weather conditions it was not poss- ible to complete the contract by said date of completion, therefore be it RESOLVED, that the - proper City Officials be'and they are hereby authorized and directed to execute'an amendment to said contract extending the time of completion to August 15, 1962 provided, however, that this resolution shall have no force or effect unless the sureties on the Contractor's bond consent thereto and file such consent in writing with the City Comptroller, andibe it FURTHER RESOLVED, that the City of St. Paul hereby waives all claim for liquidated damages and that no engineering and inspection costs on this project will,be charged to the Contractor for such extended period. t Council File No. 209890 —By Milton Rosen— , Whereas, In the matter of the Comp- troller's Contract L -6394 for the Grad- ; ing and Paving of Marion Street from 154 ft.
