07-567CouncilFile# 07-567 Green Sheet # 3041352 RESOLUTION SAINT PAUL, MINNESOTA Presented By � 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 WHEREAS, Mazatlan LLC d/b/a Mazatlan, located at 567 Stryker in Saint Paul, has requested a waiver of the 45-day notice requirement for issuance of On Sale Liquor —100 Seats or Less, On Sale Liquor — Sunday, and On Sale Liquor — 2:00 am. Closing licenses; and WHEREAS, the West Side Citizens Organization has agreed to the waiver of the notice requirements; and WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the license and that the failure to grant the waiver and the consequent delay in approving the license would cause exceptional and unusual hardship to the license applicant; and WHEREAS, the licensee agrees that in the event a complaint is received prior to the expiration of the 45-day period and the complaint provides a basis for adverse action against the license, that the Office of License, Inspections, and Environmental Protection may direct the licensee to immediately discontinue all operations until a public hearing is scheduled, and that the licensee shall comply with said directive; now, therefore, be it, RESOLVED, that the 45 day notice requirements of § 409.06 of the Saint Paul Legislative Code are hereby waived and On Sale Liquor —100 Seats or Less, On Sale Liquor — Sunday, and On Sale Liquor — 2:00 a.m. Closing licenses are issued to Mazatlan LLC d/b/a Mazatlan, located at 567 Stryker in Saint Paul, subject to the agreement stated above and the following conditions: 1. There are to be no patrons admitted to the establishment after 130 AM. Last call will be given at 1:30 AM. 2. The licensee will provide and maintain working video surveillance cameras and equipment to record activity on the premises prior to issuance of the license and in accordance with SPPD recommendations. Tapes and recordings must be maintained for a minimum of thirty (30) days, and there shall be an employee on-staff at all times during business hours with the ability to make them immediately available to the St. Paul Police Dept. and/or the Department of Safety and Inspections (DSI) upon request. 3. Exterior lighting must be maintained and adequate to support the camera/security equipment. 4. Doors and windows must remain closed during the time that entertainment is offered. Management will monitor sound levels of music to insure that neighbors are not disturbed by loud noise levels or bass vibrations. 5. Security personnel shall be assigned to each entrance starting at 9 PM and remain until all patrons have left the licensed premises, which include the parking lots. Security personnel shall verify the age of patrons by checking state or federally issued identification cards (no picture I.D., no entrance). Customers re- entering the establishment shall be subject to the same security measures as customers entering the establishment for the first time. Between 9 PM and 1 hour after closing, security/staff will patrol the parlang lots to pick up litter and to monitor lots for patron behavior that would disturb the neighbors. Licensee wili maintain a list of patrons who have been banned from the establishment for assaultive, disorderly or disruptive behavior. The list must, at a minimum, contain the names and descriptions of banned patrons, as well as the date they were advised they were banned. No persons who aze on the list shall be permitted to be in the establishment or remain on the grounds. This list will be made available upon request to the SPPD or DSI.
