Whereas, In the matter of Comptrollert's Contract L- 6170 -7 for
paving Shepard Road from Randolph to Otto and Otto from Shepard
Road to W. Seventh Street Ashbach Construction Company, Contractor,
the specified date of completion is September 1, 1961, and,
Whereas, The Contractor has prosecuted the work diligently
but due to delay in performing extra work involved in filling a
cave under the roadway authorized by Change Order No. 1, and
extra slope protection work under Change Order No. 2 it was not
possible to complete the contract by said date of completion,
therefore be it,
Resolved, That the proper City Officials be and they are
hereby authorized and directed to execute an amendment to said
contract extending the time of completion to September 15, 1962
provided, however, that this resolution shall have no force or
effect uhless the sureties on the contractor0s bond consent there -
tp and file such consent in writing with the City Comptroller,
and be it,
Further Resolved, That the City of St. Paul hereby waives
all claim for liquidated damages and that no engineering and
inspection costs on this project will be charged to the Contractor
for such extended period.
