RESOLVED, Upon and Pursuant to the Appeal, under
the Zoning Code, by Eastern Heights Evangelical Lutheran
Congregation (Missouri Synod), Owner of the subject premises
situate within the corporate limits of the City of''Saint'
Paul described as follows: '
"Lot 11 and Lot 12, except the south 133
feet of the east 50 feet of said Lot 12, _
in Block 3, Robert L. Ware's .Eastern Heights,
Acre Lots, according to the Plat thereof- on
file and of record in the office of the
Register of Deeds in and for Ramsey County,
Minnesota ";
that the provisions of said Zoning Code hereby are deter-
mined and varied, as and to the extent necessary therefor,
and the building setback line applicable to said premises,
in respect of the north line of East Fifth Street upon which
the same abut, hereby is established as that certain line
drawn across said premises parallel to and 8 feet distant
and northerly from said north line of said East Fifth Street;
and that without any delimitaUon of the foregoing provisions
hereof a Special Permit hereby is granted for the construction
and maintenance, on said premises, of the presently proposed
structural extension of the Eastern Heights Evangelical
Lutheran Congregation (Missouri Synod) Church Building
thereon, in conformity to the setback requirements of the
aforesaid building setback line as the same hereby is estab-
lished.

The City Council requested that you prepare a resolution granting the
attached appeal of Eastern Heights' Evangelical Lutheran Church for
permit to establish an 8-ft. building line setback from E. Fifth Sto
on property at the northeast corner of Ruth and E. Fifth Sts., also
described as the W2 of Lot 11, Block 31 Robert L. Ware's Eastern
Heights Acre Lots.

Dear Madam:
This is in the matter of the appeal of the Eastern Heights Evangelical
Lutheran Church to establish an 8 foot building line setback from East
Fifth Street on property located at the northeast corner of Ruth and
East Fifth Streets which is described as the west one -half of Lot 11,
Block 3, Robert L. Ware's Eastern Heights Acre Lots. The property is
zoned "A" residence.
The subject property is being developed with a new church structure,
the main portion of which will maintain a setback of 40 feet from Fifth
Street. It is proposed to construct a tower and canopy off the main
chux_ch entrance which would extPnr t� w;j r;,, R feet of t e north line
of East Fifth Street. The property under consideration is an irregular -
ly - a ra"$ ct of land having a frontage of approximately 200 feet on
the north side of East Fifth Street. The surrounding area uses are
entirely single- family residences. In order to construct the tower and
canopy as proposed, it is necessary to secure Council approval.
Field investigation discloses no objection to the request which appears
to be a reasonable one, as that portion cf the structure which will have
a setback of 8 feet from the street is at least 150 feet from the near-
est residence to the east.
In consideration of the above factors, the Board of Zoning recommends
the granting of the appeal to establish an 8 foot building line setback
from East Fifth Street on the above described property.
