RESOLVED, upon the appeal, under the Zoning Code, by Sibley
Plaza, Inc., owner of the following described real estate situate in the
City of Saint Paul, County of Ramsey, State of Minnesota, comprising a
single plot in a single ownership, to wit:
That part of Lot 22, Snelling Out Lots lying South of the
Chicago, Milwaukee, St. Paul and Pacific Railroad Company
Right- of- way;.and the North 180 feet of Lot 21, Snelling
Out Lots lying Bast of the West 167 feet of said Lot 21;
and the North 128.81 feet of the West 167 feet of said
Lot 21; also Lots 18 and 19-in Snelling Out Lots, excepting
those parts thereof taken for West Seventh St. in City of
-St. Paul,,and that part of Lots 16 and 17 in Snelling
Out Lots lying South of a line 10 feet South of and parallel
to North line of Caulfield Avenue (now Wilmot Avenue)
produced East across Lots 16 and 17, all in Snelling Out
Lots, excepting from the above described.tract those
parts thereof taken for West Seventh Street; all according
to the plat thereof'on file and of record in the office of
the Register of Deeds in and for Ramsey County, Minnesota;
a portion whereof is classified in Commercial District and the remainder whereof
is classified in "A" Residence District under said Zoning Code, that the pro-
visions of said Zoning Code hereby are determined and varied as and to the
extent necessary therefor, and a permit hereby is granted for the extension
of Commercial District uses over the entire plot heareinabove described;
RESOLVED FURTHER, that said permit for said extension of Commercial
District use to cover the entire plot shall attach to and run with the land;
and that without any delimitation of the same a special permit hereby is
granted for the erection, maintenance, and operation on the following
described part of said plot, to -wit:

The City Council requested that -you prepare a resolution granting the attached
appeal of Sibley Plaza, Inc. for an extension of Commercial use to cover property
on the east side of Davern St. between W. Seventh St. and the railroad tracks
as more fully described in the attached letter of the Zoning Board.

Dear Madam:
This is in the matter of the appeal of Sibley Plaza Inc. for an extension
of commercial use to cover property located on the east side of Davern
Street between W. Seventh Street and the railroad tracks which is de-
scribed as that part of Lot122 Snelling Outlots lying south of the
Chicago, Milwaukee, St. Paul and Pacific Railroad Co. rigbt -d -way; and
the north 180 feet of Lot 21, Snelling Outlots lying east of the west 167
feet of said Lot 21; and the north 128.81 feet of the west 167 feet of
said Lot 21, all according to the plat thereof on file and of record in
the office of the Register of Deeds in and for Ramsey County Minnesota.
The property is zoned "Alt residence.
The site is an irregularly shaped tract of vacant land having a frontage
of 222 feet on the east side of Davern Street and an area of approximately
82,090 square feet. The property is adjacent to land also classified "A"
residence and for which the Council granted an extension of commercial
use (1945) and is now developed for commercial purposes, i.e. Sibley Plaza.
It is proposed to construct two 25 -unit apartment buildings on the Davern
Street frontage and use the portion immediately adjacent to Sibley Plaza
for the expanding and enlarging of same. North and adjoining is railroad
right -of -way; west and across Davern Street are single - family residences
which front on Field Avenue; south and adjoining are single - family resi-
dences which front on Davern Street; east and adjoining is the Sibley Plaza
Shopping Center.
Field investigation discloses that the proposed apartment development
would provide a transitional use between the commercial uses to the east
and the residential development to the west.
The Board of Zoning considered the matterat their meeting on September 26,
1963 and recommend the granting of the appeal for an extension of commercial
use on the above described property for the proposal as submitted.

hereby appeal under and pursuant to provisions of Chapter 64 of Zoning Code

- The last mentioned portion "of the plot is presently improved with
-premises known as Sibley -Plaza Shopping Center. The front 100 feet of said
real estate adjacent to West Seventh Street is zoned commercial, and on
October 3, 1945 your,honorable body, council file number 134518, authorized
the extension of commercial use over the balance of lots 17 and 189 which
is zoned as "A" residential district.
- That portion of Lot 219 for which this application is being made to
extend commercial use to, is being purchased by the undersigned under Contract
for Deed, dated October 2 , 195
