The City Council requested that you draw a resolution granting an appeal
of Oro E. Odom for a 20 foot building line setback from Eustis St. on
property locat@d at the northeast corner of Carter and Eustis, described as the
west 75 feet of Lots 24 and 25, Block 40, St. Anthony Park North.
You will note that the appeal was for an 8-foot setback but the Council decided
on a 20 -foot line.

Dear Madam:
This is in the matter of the appeal of Oro E. 011am to establish an 8 foot
building line setback from Eustis Street for property located at the north-
east corner of Carter Avenue and Eustis Street which is described as the west
75 feet of Lots 24 and 25, Block 40, St.Anthony Park North. The property is
zoned "A" residence.
The site is used as yard area for the single- family residence to the east.
It is developed with a garage structure now occupied for residential purposes.
It is proposed to construct a two - family residence on the subject property
and vacate the garage. The subject property consists of part of two platted
lots having a frontage of 75 feet on the north side of Carter Avenue and 105.2
feet on the east side of Eustis StreeV, resulting in an area of 7,890 square
feet. This property, as well as the remaining lots in the block to the north,
was platted taking its frontage on Eustis Street requiring a setback of 30 feet
from Eustis Street. The applicant is proposing to construct a two - family resi-
dence which will front on Carter Avenue. The setback from Carter will.pe 30 feet
but the setback from Eustis Street is proposed to be reduced to 8 feet. To
the east and adjoining is a single - family residence which was built in 1914 and at
that time included the subject property; to the north and adjoining is a recently
constructed single - family residence having a setback of 40 feet from Eustis
Street. To the west and across Eustis Street is rigbt -of -way of Highway # 280;
to the south across Carter Avenue is a single - family residence.
Field investigation discloses that the setbacks of the other residences in
the block to the north vary from 21 feet (which was approved by the Council
approximately a year ago) to 46 feet. It appears that an 8 foot setback as
requested would have a detrimental effect on the adjoining residence to the
north and it is suggested that 21 feet be the minimum setback which would •b
in line with the residence farther north. The denial of this request would
not cause a hardship on the applicant as it is possible to develop the site
with a smaller structure, or one of a different design.
In consideration of the abovefactors, the Board of Zoning recommends the `
denial of the request to establish an 8 foot setback from Eustis Street on
the above described property.
