An Ordinance granting permission to John E. Blomquist, Inc.,
to construct, grade, and surface with suitable bituminous
material, for public pedestrian and vehicular travel, a driveway
15 feet in width within the lines of Graham Avenue, from the
westerly line of the constructed paved cul -de -sac extended
within said Graham Avenue from Wheeler Avenue westerly to
the easterly line of West Seventh Boulevard, as shown on the
accompanying plan therefor, herewith filed, and hereby
incorporated herein. This is an emergency ordinance
rendered necessary for the preservation of the public peace,
health, and safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby given to
John E. Blomquist., Inc.,'to_ construct, grade, and surface with suitable
bituminous material, for public pedestrian and vehicular travel, a driveway
15 feet in width within the lines of Graham Avenue, from the westerly line
of the constructed paved cul -de -sac extended within said Graham Avenue from
Wheeler Avenue westerly to the easterly line of West Seventh Boulevard, as
shown on the accompanying plan therefor, herewith filed, and hereby incor-
porated herein, and the Commissioner of Public Works is hereby authorized
to issue a permit therefor to said John E. Blomquist, Inc., upon its com-
pliance with the following conditions, viz:
1. Said permittee shall construct, grade, and surface said
driveway with suitable bituminous material at its own cost and expense, and
to the satisfaction and under the supervision of the Commissioner of Public
Works, and in accordance with plan therefor, herewith filed, and hereby
incorporated herein.
2. Said permittee shall pay the cost of engineering and inspection
and also the cost of publication of this ordinance.
3. Said permittee shall properly protect all excavations made in
any subject section of driveway or street, both day and night, so as to avoid
all damage or injury to person or property, and shall properly fill and tamp
any subject section of driveway or street to avoid settling.
S 4. Said permittee shall furnish a bond of $10,000 to comply with
ti all the terms of this ordinance, and to indemnify and save the City harmless
0 from any and all loss, liability, judgments, suits, costs, charges, damages
Q or expense that may accrue to person or property occasioned by the construction
acv grading and surfacing of said driveway, whereunder the City shall be obligee.

5. Said permittee, after the inception of said work, shall prosecute
the same continuously,, with diligence, and complete said work on or before
October 15, 1964.

6. Said permittee expressly agrees and undertakes to fully
indemnify and hold harmless the City of Saint Paul, its agents, officers
and employees from any and all damages, claims, losses, judgments,
suits, or expenses arising out of or occasioned by the performance of the
work contemplated by this permission and authority.
7. Said permittee shall not proceed with said work unless and
until said permittee shall have fully complied with the provisions regarding
insurance and indemnification contained in the City of Saint Paul Department
of Public Works Specifications for Street and Sewer Construction, dated
April 1, 1959, as amended, Section 1.44, and found on pages 1 -13 through
1 -17 of said Specifications applicable to contractors. For the purposes
of this ordinance, the aforesaid section of said Specifications numbered
1.441 as amended, shall read as though the word " permittee" were substituted
for the word "contractor" wherever the same appears in the aforesaid
Section 1.44. Said Section,1.44 of the Specifications for Street and Sewer
Construction in the City of-Saint Paul, as amended, is hereby incorporated
herein by reference as fully and as completely as if set forth herein
verbatim. Proof of compliance with the provisions of the aforesaid Section
1.44 shall be in such form as the Corporation Counsel of the City of Saint
Paul may direct and the documents required by the aforesaid Section 1.44
shall, after submission to the Corporation Counsel, be filed in the office
of the Comptroller of the City of Saint Paul.
8. Said permittee shall, within 30 days after the passage
of this ordinance, file a written acceptance thereof with the City Clerk.
Section 2. This ordinance is hereby declared to be an emergency
ordinance rendered necessary for the preservation of the public peace, health,
and safety.
Section 3. This ordinance shall take effect and be in force upon
its passage, approval, and publication.

A written request has been received by our office from John E.
Blomquist, Inc. with offices at 712 Northwestern Bank Building, St.
Paul 1, Minnesota. In this letter, a copy of, which is attached, they
request permission to grade and surface _a 15 foot driveway in unmaza - - +-

A plan of the pro osed i' rovement is attached to this letter.
We have cleared this through the necessary channels in the Public
Works Department and we find no objection to allowing Mr. Blomquist to
proceed with his plans. Will you, therefore, have your office draw the
necessary ordinances or take whatever action is necessary allowing Mr.
Blomquist to proceed with his request. It would be my thinking that
this would be an ordinance of the grading and surfacing type requiring,
of course, a bond and also that he do the work at his own cost and ex-
pense. It should be further provided that he pay any engineering and
inspection expenses incurred by the Department of Public Works or anj
other expenses.
From viewing the site in the field, it would appear to me that it
would not be necessary for him to furnish slope releases. Thank you
for your cooperation in this matter. If any further information is
needed, do not hesitate to call me.

we are submitting a copy of the Highway Department map of
z the area concerned. You will note shaded in blue is the
proposed driveway easement on northwest quarter of Lot 2
and north half of Lot 3, Block ll,-Homecroft Addition.

It is presently contemplated that an apartment building be
< built on this commercial zoned lot. 'The different grade
L" changes from West Seventh boulevard, the Culdasak on
W Graham Avenue and the rear property area of the lots
G affected create a situation so that the drive coming off
i West Seventh Boulevard would be Ditched rather severely
V and in my mind would create a problem in the Winter time,
getting in and out of the rear of these lots. An ideal
F situation would be as suggested and shown, where the grade
is relatively even.
