COUNCILMEN Yeas Nays DaWish_ Holland Loss Mortensen Petersen - Rosen Mr. President, Vavoulis sort 6-82 In Favor a A gainst DEC 2 0 1963 Adopted by the Council 19— DEC z 0 1g r Approved 19— Mayor 1 5925 A G R E E M E N T IT IS HEREBY AGREED by and between the City of Saint Paul, a municipal corporation, party of the first part, and Darrel Charles Oehrlein, Sr. of 655 Plum Street, Saint Paul, Minnesota, party of the second part, that in and for the consideration hereinafter expressed, said party of the second part hereby leases unto the Bureau of Parks and Recreation of the City of Saint Paul, for the period from the 16th day of December, 1963, to and including the 16th day of February, 1964, a double garage owned by said party of the second part, located at 655 Plus Street, Saint Paul, Minnesota, for use by the City as a warming house facility in connection with the City's operation of the Bluff playground. In consideration for the use of the aforesaid garage, the City of Saint Paul, through the Bureau of Parks and Recreation, agrees to pay said party of the second part the sun of Eighty Dollars ($80.00) for the term hereinbefore set forth, which amount shall be payable upon execution of this agreement. The party of the first part further agrees to save harmless the party of the second part from all claims, damages and obligations of every kind and nature arising by virtue or as a result of the City's use of said garage as a warming house facility. The City agrees to relinquish and turn back said garage to the party of the second part, in substantially the same condition the garage was at the time the City took over such facility, ordinary wear and tear excepted.
