PAUL COUNCIL NO OFfICE OF THE CITY CLERK COU RESOLUTION - GENERAL FORM PRESENTED BY r COMMISSIONER DATE FI ` incil File No. 215832 -33y Milton ,: en- .oi!•° )lved, By 'the Council of the City Paul, that subject to the pro - j _1n„ _ terms and conditions herein - afi'j 1,,,' forth, Sal F P-­1 Winter Car - y�..: i,pr.w made there- RESOLVED, by the Council of the City of Saint Paul, that subject to the provisions, terms and conditions hereinafter set forth, Saint Paul Winter Carnival Association, Inc., having made due application,to said Council therefor, hereby is author- ized and permitted to construct, maintain and operate a public ice skating rink in that certain section of Washington Street between West Sixth Street and West Seventh Street, exclusive of the sidewalk area on -the west side of Washington Street, in the City of Saint Paul, for the Saint Paul Winter Carnival period and festivities from January 24, 1964, through February 2, 1964, available at all times for public skating, without charge, and for the conduct of said festivities; be it FURTHER RESOLVED, that said permittee, Saint Paul Winter Carnival Association, Inc., shall construct, maintain and operate said ice skating rink for said public purposes dur- ing aaid period of time according to plans, specifications, rules and regulations prepared and prescribed by the Commissioner of Public Works and shall remove the same and all installations connected therewith from said section of public street and any adjacent park area used in conjunction therewith, in a manner so as to restore the same to its condition at the time of the installation of said skating rink hereunder, and that construc- tion, maintenance, operation and removal of said skating rink and related activities shall be under the supervision and subject to the control and regulation of said Commissioner; be it FURTHER RESOLVED, that said permittee shall be oblig- ated to fully indemnify and hold harmless said City, its agents, servants and employees from all claims for damages on account of the exercise of said permission and authority, and particularly on account of the construction, maintenance, operation or removal of said skating rink by said permittee, and that said permittee shall procure and furnis to said City casualty insurance coverage indemnifying said City 4 ainst liabaity on account of injury to COUNCILMEN Yeas Nays Dalglish Holland Loss Mortinson Peterson Rosen Mr. President, Vavoulis 101 8-82 VED In Favor Against Adopted by the Council 19 Approved 19— Mayor ORIGINAL TO CITY CLERK - 21- CITY OF ST. PAUL COUNCIL NO:� OFFICE OF THE CITY CLERK FILE COUNCIL RESOLUTION — GENERAL FORM PRESENTED BY COMMISSIONER DATE - FA person or property resulting from the exercise of such permission and authority by said permittee hereunder in the amount of $50,000 for each individual who may suffer personal injury, and.'.$200,000 i on account of personal injury resulting from any one accident and affecting more than one person, and in the amount of $50,000 because of injury or damage to property on account of any one accident, such insurance coverage to be evidenced by policies of insurance approved by the Corporation Counsel; be it FURTHER RESOLVED, that said permittee shall file its written acceptance of this resolution and of all the provisions, terms and conditions of the same with the City Clerk and shall submit to the Corporation Counsel for his approval, the aforesaid insurance coverages which shall thereafter be filed with the Comptroller of the City of Saint Paul, not later than January 24, 1964, and in the event of its failure so to do, the permission and authority-hereby granted shall lapse.
