RESOLVED that, subyect to the herein stated exceptions and with the accompanying Certificates
of Intended Non-Use, filed voluntatily on behalf o£ Saint Paul Regional Water Services, a
municipal corporafion; Comcast Corporation, registered under the laws of the State of
Pennsylvania; Qwest Corporation, a Colorado Corporafion; Northern States Power Company
(Electric) d/b/a Xcel Energy; a Minnesota Corporation; Northern States Power Company
(Gas) d/b/a Xcel Euergy, a public utility; District Energy/District Cooling St. Paul, a private,
non-profit corporation; City of Saint Paul, a municipality, Public Works Department; made a
part hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for
itself and on behalf of these corporations and deparhnents, waives the right to the utility
easements in the previously vacated areas, described in E�ibit A; and be it fixrther
RESOL'VED that, an additional water easement, shown as Exhibit B, is released in the northerly
33.00 feet of previously vacated Pearl Street bounded by the westerly limits of the City of Saint
Paul on the west and the centerline of previously vacated Berry Avenue on the east; and subject
to the following, including:
That Comcast retains any easement for facilities that may exist in said easement described
in E�ibit A, and that developer will relocate any facilities at its own expense and to the
satisfaction of Comcast.
2. That the petitioners, their successors and assigns have paid $300.00 as an administrative
fee for these easement releases.
That the petifioner, their successors and assigns agree to indemnify, defend and save
harmless the City of Saint Paul, its officers and employees from all suits, actions or claims
of any chazacter brought as a result of injuries or damages received or sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this
property, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petifioners or any of their agents or employees.

Ramsey County, Minnesota, described as commencing at the point of
intersection of the west line of said Berry Street with the no►therly line of
Pearl Street, originally dedicated as Pym Street in said "Eustis Addition to
St. Anthony Park, Ramsey County, Minnesota"; thence northerly, along the
west line of said Berry Street, a distance of 231.00 feet to the point of
beginning of the land to be described; thence easterly, deflecting to the
right, 90 degrees 00 minutes 00 seconds a distance of 11.00 feet; thence
northerly, deflecting to the leR, 90 degrees 00 minutes 00 seconds a
distance of 48.00 feet; thence westerly, deflecting to the left, 90 degrees 00
