RESOLVED, upon due consideration of the pertinent appeal, under
the Zoning Code, by Zion Lutheran Church, owner of the subject premises
located at and adjacent to the southeast corner of Jackson and Sycamore
Streets, described as Lots 6 and 7, Block 9, Edmund Rice's 2nd
Addition, in the City of Saint Paul, that the provisions of said
Zoning Code hereby are determined and varied as and to the extent
necessary therefor, that the building setback line applicable to said
premises, in relation to the line of Sycamore Street, upon which the
same abut',, hereby is established as a line coincident with said line
of Sycamore Street and the building setback line of said premises,
in relation to the line of Jackson Street, upon which the same abut,..,
in the nature of a side yard requirement:;, hereby is established as

on Jackson Street, resulting in an area of 12,150 square feet. It is proposed
to construct the new educational building on the north property line and al-
most to the east property line. The building line on Sycamore Street is 13
feet as established by the existing residences in the block to the east. The
required setback at the rear (east) is 25 feet as established by Chapter 60.14
of the Legislative Zoning Code.
Field investigation discloses that the proposal as submitted would be con-
trary to the purpose and intent of the Legislative Zoning Code, and would
have a detrimental effect on the residences to the east in this block.
The Board of Zoning considered this matter at its regular meeting on
October 24, 1963, and recommends the denial of the above outlined appeals.

We are acting on behalf of Zion Lutheran Church located at Sycamore - .
Avenue and Jackson Street. This church is considering a building program
which would propose to (erect an educational building on the north side of
their existing church building. It would provide Sunday School class rooms
and assembly facilities for the congregation. In order to properly implement
this program it is necessary that we ask the council to waive set back re-
structions on Sycamore and side yard set back requirements on the east
side of their property.
We request: a set back of 01 on the north property line- and a set back of 41
at the side yard at the east property line. I am enclosing a site plan showing
the location of the building and a copy of the survey of the aforementioned site.
I am also enclosing our check for $20. 00 to cover the filing fee.
We would appreciate a hearing before the planning commission as soon as
possible. I understand the next scheduled board meeting is for Octobe -r- -24th.
We would appreciate being put on this agenda if possible.

You are hereby notified that the Council of the City of St. Paul will
consider the matter of the application of Zion Lutheran Church for
appeal to establish new building lines and relax provisions of Chapter
60.41 of the Legislative Zoning Code on the following described property:
Lots 6 and 7,; Block 9, Edmund Rices 2nd Addition. The property is located
on the southeast corner of Jackson Street and Sycamore Street.
A public hearing will be held in the Council Chambers of the Court House
and City Hall in the City of St. Paul, at 10:00 a.m, on December 5, 1963.
