RESOLVED, upon due consideration of the pertinent appeal by Gustav 0. Imm, owner of the subject premises located on the north side of Wynne Avenue between Pascal and Arona Streets, in the City of Saint Paul, described as Lots 28 and 29, Block 1, Lake Park 2nd Addition, under the Zoning Code, that the provisions of said Zoning Code hereby are determined andvaried as and to the extent necessary therefor, and a special permit hereby is granted unto said appellant for the con- struction, maintenance and operation, on said premises, of a 10 -unit apartment building and a 10 -car off - street parking facility, in con- junction therewith, said determination and variation of said general provisions shall be deemed related to those pertaining to the density and minimum area requirements and other requirements; that said appellant- permittee, and his successors and assigns, in reppect to such permitted use of said premises, otherwise shall make complianQe with all applicable provisions of all municipal ordinances, state statutes and rules and regulations of public authori cognizance. . O'Connell City Clerk Building Dear Madam: This is in the matter of Gustav 0. Imm's 1) appeal to relax the density standards of Chapter 60.24 of the Legislative Zoning Code ,and 2) application for a permit to install and operate a 10 car off - street parking lot in conjunction with a pro- posed ten -unit apartment building to be constructed on property located on the north side of Wynne Avenue between Pascal and Arona Streets which is described as Lots 28 and 29, Block 1, Lake Park 2nd Addition. The property is zoned "C" resi- dence. The subject property is developed with a two- family residence which will be removed for the proposed development and has a frontage of 78.86 feet on Wynne Avenue and a depth of 123.1 feet, resulting in an area of approximately 9,713 square feet. West and adjoining is a ten -unit apartment building under construc- tion; east and adjoining is a two-family residence; to the north and across a public alley are single - family residences fronting on Breda Street; south and across Wynne Avenue is a large, vacant tract.approximately 20 feet below the grade of said street. Chapter 60.24 of the Legislative Zoning Code requires 1,000 square feet of-ground area per unit, therefore it is necessary to secure Council approval to permit the ten -unit building on a tract of land of 9,713 square feet. Field investigation discloses that the area uses are predominantly single and two - family residences although the area has been zoned "C" residence since the enact- ment of the Zoning Code in 1922. The deficiency in area is small, and the relax- ation as requested appears reasonable. The Traffic Engineer and the Planning Board staff have reviewed the parking lot plan which meets the standards for this type of facility and recommend approval. The proposal meets the requirements for building ground coverage. In consideration of the above factors, the, Board of Zoning recommends the granting of the appeal as above outlined, and the application for a ten car off -street parking facility in conjunction with a proposed ten -unit apartment building on the above described property in accordance with plans approved October 24, 1963.
