RESOLVED, That the proposed Stipulation between
the City and objectors Leigh O.Ferris and Margaret Ferris,
owners of Lots 9 and 10, Block 3, Joseph R. Weide's 2nd
Addition, for the amendment of the judgment of the
District Court of Ramsey County, Minnesota, dated October 1,
1963, so that the same shall provide for the confirmation of
an assessment of benefits, against said real estate in the
amount of $188.10 instead of $376.20, for City of Saint Paul
improvement involving grading and surfacing of east, north
and south alley in Block 39 Joseph R. Weide's 2nd Addition,
and constructing sewer therein hereby is authorized, said
larger amount being that ratified and confirmed therefor
by this Council's prior Resolution C.F. No. 2144059 approved
August 21, 1963, and the same having been inadvertently con-
firmed by said judgment despite pending objections to the
same under said owners' answer and such proposed disposition
to constitute, final compromise and settlement of pertinent
pending rues pursuant to the recommendation of the Corpora -
tion Counsel and the Commissioner of Finance. v "') I.,

from Orange Avenue to Hyacinth Avenue;
also constructing a sewer in the alley
from 130 feet North of Orange Avenue
to the existing sewer in Orange Avenue.

SECOND JUDICIAL DISTRICT
ANSWER
LEIGH O. FERRIS and MARGARET FERRIS, the owners
of Lots Nine (9) and Ten (10), Block Three (3), Joseph R.
weide's 2nd Addition, for their objections to the above
assessments, state:
I.
That said Lots Nine (9) and Ten (10), Block Three
(3), Joseph R. Weide's 2nd Addition are not benefited by said
assessments, and said assessments are contrary to law, and for
the further reason that the grade of the alley to the west of
said Lots Nine (9) and Ten (10) was changed in connection with
said improvement without compensation to the undersigned and
without authority and contrary to law; and the undersigned have
been damaged by reason of said change in grade in excess of the'
amount of the alleged assessments.
II.
That there is no valid final Order for such im-
provements and that said assessment as to Lots Nine (9) and
