The County of Ramsey, acting by and • through .its Board of 'Commissioners,.. hereinafter referred to as the. i County, both acting pursuant to the provisions of Minnesota Statutes, Section 471.55, WITNESSETHi, WHEREAS,• The City -'and the County each have the responsibility and'authority, pursuant-to Minnesota Statutes, to provide for neces- sary and proper record 'keeping, and for-the preservation, custody and control of• many' and 'varied public documents and records, and WHEREAS, Pursuant 'to the provisions. of Minnesota Statutes, the .,`,City and the.County' have the necessary legal.authority for trans - ferring records and public documents to microfilm, and taking neces -' sary 'action to destroy the original documents involved, and HEREAS, `The City `and Count .. y, .through various departments, are presently engaged in programs of-microfilming certain public records, and documents and - dest- roying the originals-thereof pursuant to such • statutory, authority, and ' WHEREAS; There'is a need for the space which can be-saved through •• • the implementation of ';a •microfilming program, together with an in- crease in the security precaution's which result from proper micro- filming, storage and'recording of public documents, -and WHEREAS? Efficiency• -.in operation at,the seat of the government of the City and the County will be improved'and enhanced by the com- bined operations for - microfilming and record keeping and storage. NOW, THEREFORE, By mutual agreement of the Parties hereto, acting by and through their respective.governing'^bodies•as aforesaid, E the following agreement-`is-entered into and made effective as follows:• 1. The microfilming program of.the•City and County shall be carried on under the supervision and control•of a•'joint City - County hZ department to be .known and described officially as the -Joint City- „ County Microfilm Department. 2, The operation and supervisory control of the Joint City- County Microfilm Department- shall be under a••supervisory committee to be composed of'the,head of the Research Bureau of the City, the County Auditor of the County and the City Comptroller. The head of the Research Bureau of the City shall be the Chairman. The County ,.Auditor shall-act-as Secretary for the Committee. ; 3. It:shall be the duty and responsibility of the Supervisory Committee:' (a) To' employ and, supervise the necessary personnel i for the operation of the Joint City - County Microfilm Department:, All personnel employed in the department shall be under the classified' civil service of the'County of Ramsey, and subject to all laws and rules and regulations-prescribed for the classified civil service of the County, and the supervision and employment of personnel for the department.shall'be in accordance with such laws and regulations. (b) To*devel•op and promulgate rules for the purchase and use of microfilm equipment and supplies,'including, reading, printing and camera machines and•necessary,film by City and County,, = departments ;(c) To supervise the department so that an efficient " and effective establishment and operation is conducted for a joint City- County microfilm program, including but not limited to the establishment of criteria for determination of what material should be reduced to microfilm consistent with existing laws on the subject. .(d) To•'a'ssist and cooperate with departments in both I. the C.ity an, d, ,Co.,u� t :y.g.o., vernment,in _ developing record management studies and surveys, to the ohd that.proper and efficient methods of record- , . ' keeping and in'dexin�-and control is exercised over the public documents, instrument's and•other•records of the various City and County departments __- including 'but not .limited to the use of, microfilming techniques and I.. equipment. (e) To exercise supervisory control over microfilm equipment and supplies purchased and used by the department or by any other department of the City and the County. (f) To request legal services from either the County Attorney or the Corporation Counsel or both; and both such offices are authorized to furnish such service. (g) Pursuant to the provisions of Minnesota Statutes Section 138.17 to provide for the storage of security copies of records - outside the nuclear target area of Metropolitan Saint Paul. 4. (a) It is agreed that the program for the operation of the Joint City - County Microfilm Department and the activities of the supervisory committee shall be financed and paid for on a basis of one -half of the expense to be contributed by each, the City and the County. It is contemplated that the initial cost for establishing the program, including the initial purchase of the various necessary equipment and supplies, will amount to the approximate sum of $50,000.00. In its budget for the year 1964,,the City and County will each appropriate to this function the sum of $25,000.00. An annual budget will be prepared and proposed by the supervisory committe :and submitted to the City Council and the County Board in time annually for review and action. (b) The supervisory committee shall have the authority and responsibility to establish a fee schedule for services to various departments of the City and County to provide for payment from the various departments for the services rendered. Service may be performe for any department, bureau, board, committee, commission or authority financed by the City or County or the City and County jointly. In establishing this fee schedule the supervisory committee will be guidec by the principle that, as near as may be practical, the charge to each department for microfilming services shall reflect the actual cost of performing the service by the microfilm department. No provision shall be made for capital investment. However, the charge shall be based upon a return of current operating expense for the department. The charge, when made, shall be certified by the microfilm department to the department head concerned, and payment shall be made as claims against the City and County departments are normally processed and paic -3- :Charges maybe made:against'departments on a varying basis when in the Judgment of the' committee the 'variance is justified by any unique. or non- standard circumstances. (c)- The accounting•for the department shall be by the County Auditor.: I- against 'the department budget shall be paid initially by the County and all billings will be on a monthly basis. Receipts shall be paid to the County Treasurer. 5. -It shall be the duty and responsibility of the supervisory. -'committee: to recommend necessary legislation, if'any is found to be desirable, to the City Council and the County,Board for consideration ii -and-submission to.the'Legislature in the regular legislative program of the City-and-County..
