That the Zoning Code, Chapters 60 to 64, inclusive, of the Saint Paul Legislative Code, pertain- ing to Use Districts, Height Districts, and Rezoning of cer- tain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone the following described property from "C" Residence District to Commercial District, to -wit: 'Lot Sixteen (16), except the West 3.5 feet of the South 60 feet thereof; all of Lot Seventeen (17) and the East two - thirds of Lot Eighteen (18) in Block One (1) Holcombe's Addition to Saint Paul, according to the plat thereof on file and of record in the of- fice of the Register of Deeds in and for Ramsey County, Minnesota, being located on the northwest corner of Dayton Avenue and Dale Street in St. Paul, Minnesota; subject to the following express exceptions and conditions: 1. On September 26, 1963, the Commissioner of Finance reported the petition sufficient with the owners of 11 of a possible 16 (68.75%) tracts of land within the prescribed 100 foot radius having signed the petition. The site is occupied by a filling station structure which was constructed prior to the enactment of the Zoning Code and was operated as a filling station until about November 1960. Because the sta- tion use has been abandoned for some time, the City Architect advised the owner that this use could not be re- established without first rezoning the property to a commercial district. It is proposed to remove the existing structure and develop the property with a new filling station. The subject property has a frontage of 76.5 feet on the north side of Dayton Avenue and 161.5 feet on the west side of Dale Street, resulting in an area of approximatelyl2,700 square feet. The surround- ing area land uses are entirely multi - residence structures with the exception of the property to the north which was recently developed with two-family residences by the Housing and Redevelopment Authority for low -rent housing. The Board of Zoning considered this petition at its regular meeting on October 10, 1963. The Board was advised by the attorney for the petitioner that the Corporation Counsel's office has ruled that the development of the subject property is a legal non- conforming use, and, due to circumstances, the petitioner is permitted to re- model within the limits of the Code (i.e. 507o of the value of the building.) The petitioner's attorney also advised the Board that the Housing and Redevelopment Authority had signed the petition only for the purpose of getting said petition before the Council, but that the Authority felt the highest and best use of the land is for residential purposes. The Planning staff also pointed out that this property is best suited for residential use, and that the proposal is inIconflict with the proposed renewal plan for the area. The applicant has indicated that he prefers to have the site rezoned. It is the opinion of the Board that it is pre- ferable to rezone the property to permit the erection of a new, modern building. We can find no special traffic hazards because of access and drive- ways to the gas station at this location that do not occur at almost all gas stations along arterial streets and especially at signalized inter- sections within the City of St. Paul. Any access point to an arterial street causes vehicular conflicts with the related possibility of acci- dents. However, there appears to be no justification for recommending against this particular station. In reviewing preliminary plans for the proposed station we notice that the northbound Dale St. left turn movement into the proposed drive- way just north of Dayton would be the most hazardous maneuver into or out of the station, Again, however, this type of movement exists at almost every station located at a signalized intersection. This is an emergency ordi- nance rendered necessary for the pres- ervation of the public peace, health and safety. The Council of the City of Saint Paul Does Ordain: SECTION 1 That the 64, inclusive, of Code, Chapters Saint !ZC Legislative Code, pertaining to Use ^ Districts, Height Districts and to f certain properties in the City of aint Paul, as amended, be and the same is hereby further amended in the Lllfollowinjg particulars to -wit: U I (a) That the following quoted language, restrictive of the use of the eal estate therein described and thereby provided to be zoned, under Amendatory Ordinance No. 12624, ap- roved December 28; 1963, from "C" esidence District to Commercial Dis- trict under said GZoning Code, and :thereby inserted in said Zoning Code, o -wit - "and without the use or employment of any advertising sign or placard Pertaining to the same ;" hereby is stricken therefrom and re- pealed; and (b) that the following quoted language contained in said Amendatory Ordinance and thereby inserted in said Zoning Code, in connection with such rezoning of said real estate, to -wit: "that the owner of said real estate, within the period of 60 days next W succeeding the publication of this C-0 ordinance, shall file with the City Clerk, in two fully executed counter- parts, the owner's written acceptance of this .ordinance;" ereby is amended to read as follo "That the owner of ,said real estawtes: , TT on or before the first day of May, vJ 1964, shall file with the City Clerk, in two fully executed counterparts, v said owner's written acceptance of o said Amendatory Ordinance, as. a hereby amended, and said Zoning Code, as hereby amended, in respect of such rezoning of said real estate and the provisions of the same there- with connected." SECTION 2 That hereby said first above quoted Provisions, of said Amendatory Ordi- nance thereby inserted in said Zoning Code, in connection with such rezoning of said real estate and in the nature of restrictions against the use or em -4 ployrnent thereon Of any advertising sign or• placard are repealed and nullified with the same intent, purpose and effect as if said first above quoted restrictive provisions had never been Inserted in either said Amendatory Ordinance or in said Zoning Code.
