DISTRICTS, HEIGHT DISTRICTS AND REZONING OF
CERTAIN PROPERTIES IN THE CITY OF SAINT PAUL,
AS AMENDED. THIS IS AN EMERGENCY ORDINANCE
RENDERED NECESSARY FOR THE PRESERVATION OF THE
PUBLIC PEACE, HEALTH, AND SAFETY.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to
64, inclusive, of the Saint Paul Legislative Code, pertain-
ing to Use Districts, Height Districts, and Rezoning of cer-
tain properties in the City of Saint Paul, as amended, be
and the same is hereby further amended so as to rezone the
following described property from "C" Residence District to
Commercial District, to -wit:
'Lot Sixteen (16), except the West 3.5 feet
of the South 60 feet thereof; all of Lot
Seventeen (17) and the East two - thirds of
Lot Eighteen (18) in Block One (1) Holcombe's
Addition to Saint Paul, according to the
plat thereof on file and of record in the of-
fice of the Register of Deeds in and for
Ramsey County, Minnesota, being located on
the northwest corner of Dayton Avenue and
Dale Street in St. Paul, Minnesota;
subject to the following express exceptions and conditions:
1. That, subject to any further reclassifica-
tion of the hereinabove described real estate by
virtue of proceedings therefor hereafter instituted,
conducted and completed according to applicable
provisions of said Zoning Code, as amended, and ap-
pl'icable provisions of the statutes of the State of
Minnesota, hereby, the employment of said real .
estate henceforth is restricted and limited -to the
following specified uses, to -wit: (a) Residential
District uses permitted by the regulatory provisions
of the said Zoning Code, as amended, in "A" Residence
District, "B" Residence District, and "C" Residence
District, thereby established, and (b) Commercial
Uses which shall include no more than the establish
ment, maintenance and conduct of a gasoline filling
station business, subject to all applicable statutes,

2. That the owner of said real estate, within
the period of 60 days next succeeding the publica-
tion of this ordinance, shall file with the City
Clerk in two fully executed counterparts, said
owner's written acceptance of this ordinance, in-
corporating, among other things, said owner's grant
unto said City of Saint Paul of a negative easement
affecting said real estate, for the imposition,
maintenance and enforcement of the aforesaid re-
strictions and,limitation.s upon the employment and
use of,the hereinabove described real estate, ap-
proved as to form and execution by the Corporation
Counsel and recordable in the office of the Register
of Deeds. That said owner's written acceptance by
apt provisions further shall obligate said owner and
the assigng of said owner in regard to said real
estate, to effectively consent to the rezoning of
said real estate to "C" Residence District, upon the
resolution of said Council requesting the same, in
the event of the cessation for a continuous period
of twelve months, of the use of said premises for
said permitted single commercial purpose.
3. That, in addition to other requirements
therefor, said written instrument of acceptance shall
incorporate a certified copy of this ordinance,; and
immediately upon the aforesaid_ filing of the same the
City Clerk shall cause one of such counterparts thereof
to be filed t f : record in the office of the Register
of Deeds in and for Ramsey County, Minnesota.
Section 2. This ordinance is hereby declared to be
an emergency ordinance- _rendered necessary for-the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, approval and publication.

ORDINANCE
This indenture made and executed thisday of April, 1964,
by and between Laurie Gas Inc. , a Minnesota corporation, hereinafter
designated First Party and the City of Saint Paul, a Municipal corporation,
hereinafter called Second Party,
WITNE SSETH:
WHEREAS, First Party is the owner in fee simple of all of the
following described real estate situate in the City of Saint Paul, County
of Ramsey, State of Minnesota, to -wit:
Lot Sixteen (16), except the West 3. 5 feet of the South 60
feet thereof; all of Lot Seventeen (17) and the East Two -

This is in the matter of the petition of A. W. Defiel, et al, to rezone from "C"
residence to commercial district property located at the northwest corner of
Dayton Avenue and Dale Street which is described as Lot 16 except the west 3.5
feet of the south 60 feet thereof; all of Lot 17 and the east 2/3 of Lot 18,
Block 1, Holcomb's Addition to St. Paul.
On September 26, 1963, the Commissioner of Finance reported the petition sufficient
with the owners of 11 of a possible 16 (68.75%) tracts of land within the prescribed
100 foot radius having signed the petition. The site is occupied by a filling
station structure which was constructed prior to the enactment of the Zoning Code
and was operated as a filling station until about November 1960. Because the sta-
tion use has been abandoned for some time, the City Architect advised the owner
that this use could not be re- established without first rezoning the property to
a commercial district. It is proposed to remove the existing structure and develop
the property with a new filling station. The subject property has a frontage of
76.5 feet on the north side of Dayton Avenue and 161.5 feet on the west side of
Dale Street, resulting in an area of approximatelyl2,700 square feet. The surround-
ing area land uses are entirely multi - residence structures with the exception of
the property to the north which was recently developed with two-family residences
by the Housing and Redevelopment Authority for low -rent housing.
The Board of Zoning considered this petition at its regular meeting on October 10,
1963. The Board was advised by the attorney for the petitioner that the Corporation
Counsel's office has ruled that the development of the subject property is a legal
non- conforming use, and, due to circumstances, the petitioner is permitted to re-
model within the limits of the Code (i.e. 507o of the value of the building.) The
petitioner's attorney also advised the Board that the Housing and Redevelopment
Authority had signed the petition only for the purpose of getting said petition
before the Council, but that the Authority felt the highest and best use of the
land is for residential purposes. The Planning staff also pointed out that this
property is best suited for residential use, and that the proposal is inIconflict
with the proposed renewal plan for the area. The applicant has indicated that he
prefers to have the site rezoned. It is the opinion of the Board that it is pre-
ferable to rezone the property to permit the erection of a new, modern building.
Therefore, the Board of Zoning recommends the granting of the petition to rezone
the above described property to a commercial district.

Gentlemen:
The Council has asked for a report from the traffic engineer regard-
ing possible traffic hazards in connection with a new gas station which
Is proposed at the northwest corner of Dale and Dayton.
We can find no special traffic hazards because of access and drive-
ways to the gas station at this location that do not occur at almost all
gas stations along arterial streets and especially at signalized inter-
sections within the City of St. Paul. Any access point to an arterial
street causes vehicular conflicts with the related possibility of acci-
dents. However, there appears to be no justification for recommending
against this particular station.
In reviewing preliminary plans for the proposed station we notice
that the northbound Dale St. left turn movement into the proposed drive-
way just north of Dayton would be the most hazardous maneuver into or

Does Ordain:
SECTION 1
That the 64, inclusive, of Code, Chapters

nullified with the same intent, purpose
and effect as if said first above quoted
restrictive provisions had never been

That the following quoted language
contained in Section 3 of said Amenda-
tory Ordinance and thereby inserted
in said Zoning Code:

a certified copy of this ordinance,
and immediately upon the aforesaid
filing of the same the City Clerk
shall cause one of such counterparts'
thereof to be filed of record in the'
