RESOLVED, upon and pursuant to the pertinent appeal, under
the Zoning Code, of Robert E. Pace, owner of the subject real estate
situate in the City of Saint Paul abutting on the north side of East
Minnehaha between Birmingham and Barclay Streets and described as
follows: All of Lots 5 through 9 inclusive and west 10.5 feet of Lot 4,
Block 13, Denslow's Rearrangement, that the provisions of said Zoning Code
hereby are determined and varied as and to the extent necessary therefor
and that any requirement of said provisions of said Zoning Code for an
8 -foot buffer setback between the line of said premises and that of the
adjoining premises in connection with the establishment, maintenance, and
operation of a 28 -car private off - street parking facility thereon, hereby
are entirely dispensed, and that, pursuant to said owner's application
therefor, a permit hereby is granted unto said owner and his successors
and assigns, for the establishment, maintenance, and operation, on said
hereinabove first described real estate, of a 28 -car private off - street
parking facility, according to the approved plan therefor herewith filed,
and without any such buffer setback requirement, and that, otherwise, in
respect of such permitted-use of said real estate, said owner and his
successors and assigns shall make due compliance with all applicable
municipal ordinances, State statutes, and rules and regulations of public

off - street parking lot on the north side of E. Minnehaha Ave. between Birmingham
and Barclay, as further described in the first paragraph of the attached letter
and in accordance with applicant's plan dated October 18, 1963, and also
granting the appeal of Robert E. Pace for a setback or building line as
described in the attached letter of B. R. Teig and /or the appeal.

This is in the matter of the application of Robert E. Pace to con-
struct a 28 -car private off - street parking lot and appeal to waive
the 8 -foot parking lot setback requirement when adjacent to other
residential development. The property under consideration is situ-
ated on the north side of E. Minnehaha Avenue between Birmingham 6
Barclay Streets, and is described as all of Lots 5 through 9 in-
clusive and west 10.5 feet of Lot 4, Block 13, Denslow's Rearr. and
is classified in the commercial district. The -app-licant proposes
to construct one 17 -unit and one 11 -unit 2 -1/2 story apartment build-
ing for which the parking lot will be accessory thereto.
Field investigation discloses that the area uses consist of.single-
family residences to the north; vacant commercial land to the east;
a recently constructed apartment building on the west; and vacant
commercial land across Minnehaha Avenue to the south.
There would be no objection to-developing this land as proposed as
it would be more in keeping with the existing uses now in the area.
The proposed land -use plan also indicates it to be best suited for
apartment development.
The site is 210.5 feet in width and 134.35 feet in depth resulting
in an area of 28,281 square feet. This proposal meets the density
requirements and building ground- coverage standards of the Zoning
Code, and the off-street parking lot plan meets the requirements of
the off - street parking lot ordinance with the exception of the 8 -foot
screen - planting buffer which, in this case, would serve no buffering
purpose as it would lie between two parking lots.
The Traffic Engineer has reviewed the parking lot plan and recommends
approval of-same with the condition that the public alley adjoining
be graded and surfaced from Birmingham Street to the east line of the
above- described property by the applicant, at his expense and in
accordance with all ordinances governing such improvements.

In view of the above findings the Board of Zoning at its meeting
of October 24, 1963, recommended approval of (1) the application
for a 28-car off - street parking lot and, (2) the waiving of the
8 -foot parking lot buffer as requested. This approval is subject
to the applicant's grading and surfacing the adjoining public
alley at his expense from Birmingham Street to the east line of
the above - described property in accordance with all ordinances
governing such improvements and also in accordance with the
applicant's plan dated October 18, 1963.
