hereby is established, in respect of the line of Morgan
Avenue upon which the same abuts as a line drawn across
said real estate parallel to said line of Morgan Avenue

posed upon said Appellant the obligation to construct and
maintain a redwood facade upon the garages located or which
shall be located on said premises, and to install and main-
tain screen planting, subject to the approval of the City
Architect, within the said 12 feet setback area of said
premises between said building setback line and said line of
Morgan Avenue upon which said premises abut; that said Ap-
pellant or its successors and assigns, if any, in respect of
said premises, within 30 days next succeeding approval of
this Resolution, shall file with the City Clerk its or their

Dear Madam:
This is in the matter of the appeal of Bisanz Bros. Development Company to
establish a 12 foot setback from Morgan Avenue for property located on -the
south side of said street between Davern Avenue and Edgcumbe Road. 'The
property is described as all lots 1 thru 10 and vac..alley adj. said lots
the south and east 1/2 of vac. alley adj. lot 10 on west, all in Blk.
Grandport Add; all of Lots 6 thru 14 & vac. alley adj. said lots'on the south,
Block 4, Granport Add. also that part of vacated S. Wheeler St. ;lying between,
Lot 1, Block 3 and Lot 14, Block 4, Granport Add. The subject property.was
reclassified to a "C" residence district in November 1960.
The site is developed with five 17 -unit apartment buildings and one "23 -unit
multi - family structure for a total of 108 aparment units. There-iss an off -
street parking lot along the Morgan Avenue frontage with a capacity for 108
cars. The plans-' -this development were approved by the Council in June,
1962.
The applicant proposes to construct 108 garage stalls to replace the existing
108 open lot parking spaces which would be erected at the same location.
The present setback previously established by the Council on the south side
of Morgan Avenue is 24 feet. The applicant is appealing this setback under
the provision of Section 64.03 of the Zoning Code to establish a 12 foot
setback.
The subject property has a frontage of approximately 871.4 feet along the
south side of Morgan Avenue and extends to a depth of 138.84 feet resulting
in a total area of approximately 120,986 square feet. East and adjoining-
subject property-is vacant land classified "C" residence; north and across
Morgan Avenue are four single - family homes fronting on said street and
several vacant lots classified "A" residence; west and adjoining is a tract
being developed with an apartment building, north and across St. Paul Avenue
is the Jewish Community Center building.
The Board of Zoning considered the matter at its October 10, 1963 meeting
and recommends approval of the appeal to establish a 12 foot setback on the
above- described property subject to the garages being faced with redwood and
that screen planting be installed in .the 12 foot setback from Morgan Avenue.

We have a great many requests for garages.and we intend to erect them in
the same spaces now used for outdoor parking. We feel that the garages
Will be an addition to our property and will add to the overall appearance
of our project.
In order to accomplish this it will be necessary to change the building
setback line on Morgan Avenue from the present 24 foot setback established
by the Council to a 12 foot setback.
You will find attached a print showing the proposed location of the garages
together with property descriptions and drawings.
It will be our inteb --.ion to eventually have garages in all spaces now
reserved for parking.
We hereby request that the building setback line on Morgan Avenue be changed
from 24 feet to 12 feet.

of the proposed construction, appear as a jail -like structure ex-
tending over the two block area. It seems to us rather unusual

and we would only hope that the council will give this matter very
serious consideration and consider very carefully the precedent
that would be established in creating such a monstrosity fronting
on a public street.

of property described in the appeal of Bisanz Bros. Development Co.
to reduce the Morgan Avenue setbacks to 12 feet which is minimum
zoning requirements. There is to be a public hearing on this
appeal at 10:00 A.M., November 21, 1963.
We, the undersigned homeowners, will not protest this reduction of
zoning requirements per above appeal on this condition:
That granting reduced setbacks along the South side of Morgan Ave.
will not make it impossible for year -round screening of garages and
parking area by fir trees provision of which was previously
promised by Mr.,Leonard Bisanz. When adjacent homeowners were in-
formed that large parking areas instead of apartment fronts would
line the South side of Morgan Avenue Mr. Leonard Bisanz promised
this area would have attractive year -round screening (for at least
the Western half of the mentioned area as he said he could not
speak for his brothers.). He as receWly as Thursday, November 14,
1963, reiterated this promise to one of the undersigned.
If the present unsightliness of the said area is adequately screened,
the affected homeowners feel it is a moot question whether minimum
zoning requirements are maintained. Unfortunately it seems that
only well planned landscaping by Bisanz Bans, Development Co. can
save Morgan Avenue from an alley appearance and protect adjacent
homeowners from further property depreciation.
Our protests are therefore, allayed on the basis of Mr. Leonard
Bisanz' assurances that he will effect such landscaping.
